Order
1. The present writ petition is filed challenging the order dated 25.08.2026 whereby the learned Divisional Commissioner, Bikaner has granted interim order upon an appeal preferred by private respondent/respondent No.4/Mohd. Aslam.
2. Learned counsel for the petitioner submits that as a matter of fact, the appellant-Mohd. Aslam is having no locus to challenge the namankan done in favour of the petitioner by way of succession and having no right whatsoever over the land of the petitioner. However, the appellate Court without prima facie has proceeded to grant interim order against the present petitioner.
3. Matter requires consideration.
4. Learned counsel for the petitioner is directed to supply copy of the writ petition to Mr. S.R. Paliwal to represent the respondent Nos.1, 2 and 3.
5. Notice be issued to respondent No.4 in two sets. One set be given ‘dasti’ to the counsel for the petitioner for effecting service upon the respondent No.4 through registered post, returnable within a period of two weeks. Service upon the proforma respondent Nos.5 to 39 is dispensed with at this stage on the request of counsel for the petitioner.
6. Put the matter after two weeks.
7. In the meantime, effect and operation of order dated 25.08.2025 shall remain stayed. It will be open for the respondents to move appropriate application for vacation/modification of this order.
