1. The instant writ petition is filed by the petitioner with following prayer:-

"(i) by an appropriate writ, order or direction, the respondents may kindly be directed to sanction the pension from the date of retirement of petitioner and also pay arrears thereof with interest.

(ii) by an appropriate writ, order or direction, the respondents may kindly be directed to pay the amount of 300 P.L., commutation of 16 1/2 months and other benefits with interest @ 18%

p.a.

iii) Any other order which this Hon'ble Court deems just and proper in the facts and circumstances of the case may also be passed in favour of the Petitioner."

2. An additional affidavit of Mr. Mahendra Singh Bhukar, Director, Pension Department, Govt. of Rajasthan, is filed on record along with documents.

3. Learned counsel for the petitioner submits that after calculating 22 and a half years as service, the pension was calculated in favour of the petitioner. He further submits that without proper calculation, revised PPO was issued by the Pension Department.

Learned counsel appearing on behalf of the respondent- Pension Department submits that as per recommendation of the Department and after following Rule 54 of the Rajasthan Civil Services (Pension) Rules, 1996, they have prepared revised PPO on basis of basic pay @ ₹75600/- per month as last pay drawn, and accordingly revised PPO has been issued to the petitioner. He further referred Annexure-R/1 and submitted that the petitioner has acknowledged that service from 30.04.1986 to 23.02.1999, total 12 years, 9 months and 23 days is not computable for the purpose of pension.

Learned counsel appearing on behalf of respondents-Sanskrit Education Department has supported the arguments advanced by the counsel for the respondent-Pension Department and she submits that as per the proposal of the department, a revised PPO has been issued, and nothing survives in this writ petition.

Having taken note of the aforementioned fact as available on record by way of additional affidavit along with documents, the matter stands closed as in pension proposal form (Pension Kulak) itself, the petitioner acknowledged that period from 30.04.1986 to 23.02.1999, total 12 years, 9 months and 23 days is not computable for the purpose of pension, thus computation of total length of service is based on recommendation made by the parent Department (Sanskrit Education).

If the petitioner has any other ground to challenge computation/calculation on length of service or any other grievance, he is free to agitate or may opt to file fresh writ petition but in the instant writ petition, the relief claimed by the petitioner has already been granted to the petitioner, hence, the matter stands closed with all pending application.

8. With the aforesaid, the writ petition stands disposed with pending application, if any.
