1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.0066/2024 registered at Police Station-Special Police Station, SOG, District-ATM and SOG for the offences under Sections 420, 467, 468, 471 and 120-B of IPC and Sections 3, 4, 6 and 10 of the Rajasthan Public Examination (Prevention of Unfair Means) Act, 2022.
2. Heard learned counsel for the petitioner as well as learned Government Advocate and perused the material available on record.
3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is argued that the allegation against the petitioner is that she was found using bluetooth device while taking examination conducted by the RPSC. It is further contended that the similarly situated co-accused-Sunil Jakhar, Ram Singh, Om Prakash, Ms. Nirma Manda, Anil Saran, Sunil Dhayal, Praveen Kumar, Rajaram and Deepak Prajapat have already been enlarged on bail by the Co-ordinate Bench of this Court and Suresh Chandra and Mukesh Lora were released on bail by this Court on 19.05.2025. It is further contended that the present petitioner is a lady, aged about 30 years, who is in judicial custody since 05.03.2025 and charge-sheet has been filed, in which 97 witnesses have to be examined, therefore, trial of the case may take considerable time, hence on the ground of parity as well the petitioner being a lady, may be released on bail.
4. Learned Government Advocate has vehemently opposed the bail application and stated that the petitioner is found indulged in unfair practices in examination, therefore the bail application of the petitioner may not be allowed.

On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, especially the admitted position that similarly situated co-accused have already been enlarged on bail, therefore for maintaining the parity but without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner.

Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the petitioner-Shilpa Vishnoi D/o Late Shri Rampratap Vishnoi W/o Shri Sunil Kumar Vishnoi shall be released on bail on her furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court for her appearance before that Court on all the dates till conclusion of the trial.
