1. Learned counsel for the petitioner submitted that the petitioner prior to the filing of the instant writ petition, filed S.B. Civil Writ Petition No.4114/2025 (Ma Bharti Nursing College vs. State of Rajasthan & Ors.) before this Court aggrieved by the fact that the petitioner- Institution has not been granted the requisite NOC by the State Government even after due inspection and issuance of a positive report in favour of the petitioner-Institution, by the Rajasthan Nursing Council.

Learned counsel for the petitioner further submitted that after hearing both the parties, a co-ordinate Bench of this Court vide order dated 11.03.2025, directed the respondent No.1 and 3 to permit the petitioner to participate in the upcoming counseling for B.Sc. (N) course for 60 seats for the academic year 2025-

2026.

Learned counsel submitted that to the utter disbelieve and surprise of the petitioner- Institution, the respondents, despite an interim order dated 11.03.2025 passed in favour of the petitioner- Institute, vide letters/communication dated 05.05.2025 and 17.06.2025 has informed the petitioner- Institution that it cannot be permitted to participate in the counseling for B.Sc. (N) course for the academic year 2025-2026 for want of requisite NOC by the State Government.

4. Issue notices to the respondents.

5. Shri Narendra Singh Rajpurohit, learned AAG accepts notice on behalf of respondent No.1- State. Shri Mahendra Vishnoi, learned Advocate accepts notice on behalf of respondent No.-3. Therefore, service of notices upon respondents No.1 and 3 is complete.

6. Issue notice to respondent No.2 only. Rule is made returnable within a period of eight weeks.

7. In the meanwhile and till further orders, effect and operation of the letters/ communication dated 05.05.2025 and 17.06.2025 issued by the Registrar, Rajasthan University of Health and Sciences to the Principal of the petitioner- Institution, shall remain stayed. The petitioner- Institution shall be allowed to participate in the upcoming counseling for B.Sc. (N) course for 60 seats for the academic year 2025-2026.

8. List the matter after eight weeks along with S.B. Civil Writ Petitions No.15656/2024 and 4114/2025.

9. Registry is directed to reflect the name of Shri Narendra Singh Rajpurohit, learned AAG and Shri Mahendra Vishnoi, learned Advocate in the cause list as counsel appearing for the respondents.
