1. The present writ petition has been filed with the following prayers:-

“(i) Quash and set aside the impugned ex parte order dated 30.10.2024 (Annex.6) passed by the Rajasthan Staet Information Commission (Respondent No.2), in the Second Appeal filed by the Petitioner under Section 19(3) of the Right to Information Act, 2005; AND (ii) Quash and set aside the consequential rejection communications dated 20.11.2024 and 12.12.2024 (Annex.8) issued by the office of Respondent No.2, whereby the representation dated 18.11.2024 (Annex.7) submitted by the Petitioner for recall/ restoration of the said ex parte order was arbitrarily rejected; AND (iii) Direct the respondent No.2/Rajasthan State Information Commission to restore the Petitioner’s Second Appeal to its original number and stage, and to re-adjudicate the matter afresh on merits after granting due and effective opportunity of hearing to the Petitioner in accordance with law; AND (iv) Pass appropriate directions to Respondent Nos.3 and 4, namely, the First Appellate Authority-cum- Sarpanch and the Public Information Officer-cum- Village Development Officer, Gram Panchayat Sanwara, to produce the original record of the RTI proceedings and submit a written explanation for the non-compliance and misleading submissions made before the Commission; and (v) Pass such further or other order(s), writ(s), or direction(s) as may be deemed just, fit and proper by this Hon’ble Court in the interest of justice, equity, and good conscience.”

2. The facts in brief are that an application under Right to Information Act, 2005 (for short, ‘the Act’) was moved by the petitioner on 15.05.12004 seeking the following information:-

2.1 When the required information was not made available, the petitioner preferred first appeal on 21.06.2024 but the First Appellate Authority, vide communication dated 10.10.2024, informed the petitioner that he may physically inspect the documents and he would be allowed 100 pages from the record.

2.2 Therefore, being aggrieved of the aforesaid communication dated 10.10.2024, preferred a second appeal before the Rajasthan State Information Commission, which came to be dismissed
