1. This contempt petition has been filed by the petitioner alleging non-compliance of the order dated 26.05.2025 passed by the Co-ordinate Bench of this Court.
2. Vide order dated 26.05.2025, the respondents -contemnors were directed to allow joining of petitioner on the Post of Teacher Grade III Level I, pursuant to appointment order dated 29.09.2023 at Government Upper Primary School, Kesar Singh Ki Dhani, Adarsh Chuli, Chuli District Barmer, within a period of thirty (30) days’ only from the date of passing of the order.

Learned counsel for the petitioner submits that even after passing of more than three months, the respondents contemnors have not allowed joining of the petitioner, who is an unemployed person, though the directions were given to give appointment to the petitioner within a period of thirty (30) days’
only.
4. Learned Additional Advocate General appearing for all the respondents submits that the State has taken the decision not to file an appeal against the order dated 26.05.2025 and the petitioner would be allowed joining within a period of four weeks.

Considering the submissions made by learned counsels appearing for the respective parties and perusal of the order, this Court finds that on 26.05.2025, the respondents -contemnors were directed to allow joining of the petitioner on the Post of Teacher Grade- III Level I, pursuant to appointment order dated 29.09.2023 within a period of thirty (30) days’ but the petitioner has not been allowed joining even after passing of three months thereafter. The facts clearly shows that the respondents -contemnors have no due respect towards the orders of the Court. 8. Respondent Nos.2 & 3 shall file their separate affidavits as to why they have not complied with the order of the Court so far? In their separate affidavits, they shall also mention that who is accountable for non-compliance of the order of the Court within the given time so as to hold accountable the concerned Officer for the payment of the period up till joining, which the petitioner would have received if he would have been allowed joining within the time given by the Court. The affidavits will be filed within a period of one week.
9. If the petitioner is not allowed joining by the next date of hearing, both the respondent Nos.2 & 3 shall remain personally present before this Court on 17.09.2025.
10. List this matter on 17.09.2025.
