1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 72/2025 registered at Police Station Mandrail, District Karauli for the offences under Sections 115(2), 126(2), 109(1), 3(5) of BNS and Sections 3(1)

(r), 3(1)(s), 3(2)(va) of SC/ST Act.

2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is alleged against the petitioner that she passed on information about the location of the deceased to the co-accused Udai Singh. The police after thorough investigation has charge-sheeted the petitioner for the offence under Sections 115(2), 126(2), 103(1), 3(5) and 61(2) of BNS. The main allegation of causing death of the deceased Kamal is against other co-accused namely Udai Singh, Laxman and Bhura. In the statement of eye-witnesses they have also stated against the other co-accused regarding causing death of the deceased Kamal. It is also contended that petitioner has been solely implicated in this case on the basis of call recordings transpired between co-accused Udai Singh and present petitioner. Apart from the call details there is no substantive evidence available on the record to the fact that petitioner was found to be involved in hatching conspiracy to kill the deceased alongwith other co-accused. The accused-petitioner is in custody since 05.07.2025 and the trial of the case may take considerable time. Charge-sheet has already been filed before the concerned trial court, therefore considering the above facts, the bail application of the accused-petitioner may be allowed.

Learned Public Prosecutor and learned counsel for the complainant have vehemently opposed the bail application and contended that petitioner was having illicit relationship with co- accused Udai Singh and she passed on information about the location of the deceased to him, therefore, considering the nature of allegations the bail application of the accused-petitioner deserves to be dismissed.

4. Heard and perused the material available on record.

5. The main allegations of causing death of the deceased Kamal is against Udai Singh, Bhura and Laxman. The petitioner was not present at the place of occurrence alonwith the other co-accused. It is not desirable for the court to express anything on the merits of the case, considering the fact the accused-petitioner is in custody since long and the trial of the case may take considerable time, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 483 of BNSS is allowed and it is ordered that the accused-petitioner Meena W/o Nawal, in connection with FIR No. 72/2025 registered at Police Station Mandrail, District Karauli shall be enlarged on bail provided she furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for her appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
