1. This second bail application under Section 439 Cr.P.C. (483 of B.N.S.S.) has been filed by the petitioners who have been arrested in connection with F.I.R. No.90/2022 registered at Police Station Rawatbhata, District Chittorgarh, for offences under Sections 147, 148, 149, 302, 307, 323, 324, 325, 326, 384, 449, 450, 452 and
120-B of the I.P.C.
2. Heard learned counsel for the petitioners and learned Public Prosecutor. Perused the material available on record.
3. Learned counsel for the petitioners submitted that co- accused persons, namely, Parasram Mawata @ Parsa (S.B. Cr.
Application No.2752/2023), Bansi Lal @ Bansi Banjara & Charan Singh Rawat @ Chain Singh Rawat (S.B. Cr. Misc. Bail Application No.9027/2023), Hukamchand (S.B. Cr. Misc. Bail Application No.7752/2023) and Lala @ Narendra Singh & Rameshchandra @ Birdhichandra (S.B. Cr. Misc. Bail Application No.10689/2023) have already been enlarged on bail by this Court as well as the coordinate Benches of this Court. Learned counsel submitted that the case of the present petitioners is not distinguishable from that of the above named co-accused who have already been enlarged on bail. Learned counsel submitted that the petitioners are in judicial custody and the trial of the case will take sufficiently long time, therefore, the benefit of bail may be granted to the accused-
petitioners.
3. Per contra, learned Public Prosecutor has opposed the bail application. However, he was not in position to refute the fact that above named co-accused have already been enlarged on bail.
4. Having considered the rival submissions, facts and circumstances of the case so also the fact that above named co- accused have already been enlarged on bail, without expressing any opinion on merits/demerits of the case, this Court is inclined to enlarge the petitioners on bail.
5. Consequently, this second bail application under Section 439 Cr.P.C. (483 of B.N.S.S.) is allowed. It is ordered that the accused- petitioners, namely, Arjun S/o Dhannalal Ji and Sonu@ Parikshit Gurjar S/o Brajmohan arrested in connection with F.I.R. No.90/2022 registered at Police Station Rawatbhata, District Chittorgarh, shall be released on bail, if not wanted in any other case, provided they furnishes a personal bond of Rs.50,000/- and two sureties of Rs.25,000/- each, to the satisfaction of learned trial Court, for their appearance before that Court on each & every date of hearing and whenever called upon to do so till completion of the trial.
