1. Present matter comes up for consideration of this Court on application I.A. No. 1/2024, praying for disposal of writ petition on terms of judgment dated 05.04.2024 passed by Coordinate Bench of this Court in S.B. Civil Writ Petition No. 11330/2023 (Shri Roop Rajat Goushala Sansthan Vs. State of Rajasthan &

Ors.)

2. Learned counsel for the petitioner submitted that the issue involved in present writ petition relates to allotment of land for the purpose of grazing of cattle / development of Gaushala under the provisions of Rajasthan Land Revenue (Allotment of Land to Gaushalas) Rules, 1957.

3. Learned counsel for the petitioner also submitted that facts as well as issues involved in present case are similar to facts/issues involved in the case of Shri Roop Rajat Gaushala Sansthan (supra) and, therefore, prayed for disposal of present writ petition in terms of judgment dated 05.04.2024 passed by this Court.

4. Learned counsel for the respondents did not oppose the averments made by learned counsel for the petitioner and candidly stated that the issues involved in present writ petition are covered by judgment passed in Shri Roop Rajat Gaushala Sansthan (supra).

5. Present writ petitions have been filed with following prayers:-

S.B.C.W.P. No. 9161/2022:-

“A. by appropriate writ, order or direction order cum communication dated 17.01.2022 (Annexure-14) passed by office of District Collector Jodhpur may kindly be quashed and set aside and further the District Collector may directed to reconsider the proposal according to the Provision of Rajasthan Land Revenue (allotment of land to Gaushalas) Rules, 1957.

B. by appropriate writ, order or direction the respondent District Collector Jodhpur may kindly be directed to pass the allotment order in favour of the petitioner with regard to land of khasra no. 71 rakba 7 bigha land of village Badikala, as per the recommendation of Tehsildar Bilara for purpose to grazing of the cattle/development of Gaushala.

C. by appropriate writ, order or direction the respondents may kindly be restrained to interfere with the use and occupation of petitioner society for operation of Guashala upon the land of khasra no. 71 rakba 7 bigha of Village Badikala, Tehsil Bilara.

D. any other relief, which this Hon’ble Court deems fit by which the petitioner may get full justice may also be allowed.”

S.B.C.W.P. No. 14248/2024:-

“A. by appropriate writ, order or direction, notice cum dispossession order dated 28.06.2024 (Annexure-18) passed by office of Naib Tehsildar Bilara District Jodhpur may kindly be quashed and set aside and further the District Collector may directed to reconsider the proposal according to the Provision of Rajasthan Land Revenue (Allotment of Land to Gaushalas) Rules, 1957.
