1. These instant bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No.225/2023 registered at Police Station Nokha, District Bikaner, for the offence(s) under Sections 420 & 409 of IPC.

2. Learned counsels for the accused-petitioners submit that the accused-petitioners have falsely been implicated under Sections

420 & 409 of IPC. It is argued that against the Manager, who is complainant in the present case, FIR was lodged with regard to misappropriation of amount and criminal breach of trust. It is also argued that the matter is triable by Magistrate and there is no criminal antecedents against the petitioners. The petitioners are behind the bars since 13.02.2026 and further investigation/trial of the case may take considerable time, therefore, these bail applications of the accused-petitioners may be allowed.

Learned Public Prosecutor has vehemently opposed these bail applications and contended that petitioners being appointed as Field Manager in the Bank, collected amount of various debtors and did not deposit the same amount in the Bank. The amount misappropriated by the petitioner Shakti Singh is Rs.11,13,823/- and Rakesh is Rs.2,21,774/-, therefore, considering the aforesaid facts, these bail applications filed by the accused-petitioners deserve dismissal.

4. Heard and perused the material available on record.

Considering the arguments advanced by learned counsel for the petitioners and looking to the fact that the matter is exclusively triable by Magistrate and there are no criminal antecedents against the petitioners; a similar report was lodged by the Bank Officer against the complainant Manish Yadav, who at the relevant time was the Credit Manager in the Bank, therefore, without commenting anything on the merits of the case, this Court deems it just and proper to enlarge the accused-petitioners on bail.

6. Accordingly, these bail applications under Section 483 BNSS are allowed and it is ordered that the accused-petitioners namely:

1. Rakesh S/o Mangi Lal & 2. Shakti Singh S/o Ram Singh, in connection with FIR No. 225/2023 registered at Police Station Nokha, District Bikaner, shall be enlarged on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
