1. The instant interim bail application has been filed under Section 483 of the BNSS on behalf of the petitioner, who is in custody in connection with FIR No. 187/2024 registered at Police Station Bichwal, Bikaner, for the offences under Sections 103(1), 115(2), 126(2), 125, 109(2), 191(2), 191(3), 190 and 61(2)(A) of the BNS and Sections 3/25(1-B)(A) and 27 of the Arms Act, on the ground that his son is seriously ill and undergoing continuous medical treatment.

It is averred in the application as well as submitted by the learned counsel for the petitioner that the son of the petitioner is suffering from serious ailments since birth, including heart-related and breathing complications, and is presently admitted in Kothari Hospital, Bikaner, where his treatment is ongoing. It is further submitted that there is no other male member in the family to look after the child and, therefore, the presence of the petitioner is indispensable. It is also submitted that earlier the petitioner was granted interim bail for a period of 40 days and he had surrendered on time, however, the condition of his son continues to be critical. Hence, it is prayed that the petitioner may be granted indulgence of temporary bail.
3. Learned Public Prosecutor has opposed the bail application.
4. Heard learned counsel for the petitioner and the learned Public Prosecutor. Perused the material made available to this Court including the medical documents placed on record. Considering the serious medical condition of the petitioner's son, the fact that the petitioner had earlier availed interim bail and surrendered on time, and there being no other male member in the family to take care of the child, this Court is of the view that a case for grant of temporary bail is made out on humanitarian grounds.

Accordingly, the instant interim bail application is allowed and it is ordered that the petitioner named in the cause title shall be released on temporary bail for a period of 30 days from the date of his actual release provided he furnishes a personal bond in the sum of Rs. 50,000/- alongwith two sound and solvent sureties in the sum of Rs. 25,000/- each to the satisfaction of the trial court. He shall surrender before the concerned jail authorities in the morning of the next day of the completion of the period of temporary bail.
