1. Petitioner contends before this Court that his height conforms to the standards prescribed by the Recruitment Board, or in the alternative, falls within the permissible relaxation under the applicable norms. In such circumstances, the non- consideration/rejection of the petitioner’s candidature by the Recruitment Board on the ground of deficiency in the prescribed height is illegal, and contrary to law.
2. Learned counsel for the petitioner has relied upon the order dated 01.02.2023, passed by Co-ordinate Bench of this Hon’ble High Court in S.B.C.W.P. No. 17443/2022 (Ankur Garasiya Vs. State of Rajasthan & Ors.). The relevant extract is reproduced herein below:
“1. The present writ petition has been preferred with a grievance that the respondents have wrongly rejected petitioner’s candidature on the parameter of height though his height is more than the requisite height.
2. On the basis of material placed on record, on 18.11.2022, a Co-ordinate Bench of this Court passed the following order:-
“The petitioner is aggrieved of the fact that in the Constable Recruitment -2022 in the PST, though the petitioner has been passed, the same is with relaxation on account of which, though the petitioner is higher in merit, as candidates with the normal height i.e. 168 cm are available in petitioner’s category, they have been selected.
Reliance has been placed on a health certificate issued by Medical Officer, Mahatma Gandhi Hospital, Banswara (Annex.13), wherein the height of the petitioner has been indicated as 168.6 cm, whereas in the physical measurement test report taken during the recruitment, the height of the petitioner has been measured at 166.9 and in appeal, the same has been measured at 167 cms.
In view of the submissions made, in case, petitioner deposits a demand draft in the name of Legal Services Authority of this Court in a sum of Rs.10,000/- by 30.11.2022, the petitioner would be subjected to measurement of his height at AIIMS, Jodhpur on 6.12.2022.
A copy of the petition as well as order be supplied by learned counsel Mr. Mukesh Rajpurohit, Dy. SG, who will communicate the order to the Medical Board, AIIMS, Jodhpur and produce the report in sealed cover before thisCourt on the next date.
A copy of the writ petition be also supplied toMr. Manish Vyas, AAG.
List on 9.12.2022.
The demand draft be not deposited with bank by the Legal Services Authority without orders of this Court.
Office is directed to reflect the name of learned counsel Mr. Manish Vyas, AAG and Mr. Mukesh Rajpurohit, Dy. SG as counsel appearing for the respondents in the cause list.”
3. Pursuant to the order passed by this Court, petitioner’s height has been measured by the Board constituted at All India Institute of Medical Sciences (AIIMS), Jodhpur.
4. According to such report, the petitioner’s height has been measured at 168.1 cms.
5. Admittedly, the height required for the purpose of recruitment in question is 1
