1. The instant criminal misc. petition has been filed for quashing of FIR No.516/2014 registered with Police Station Mahuwa, District Dausa for the offences under Sections 363 and

366 IPC.

2. Learned counsel for the petitioner submits that both the petitioners are major and they have performed marriage. However, their family members were not happy with their marriage, hence, they approached this Court by way of filing S.B. Criminal Misc. Petition No.4720/2014, wherein, after taking note

[2026:RJ-JP:13160] (2 of 3) [CRLMP-5057/2014] of the facts of the case, protection was granted by the Co-ordinate Bench of this Court to the petitioners to save their life and liberty. Counsel submits that father of the petitioner No.1 i.e. prosecutrix is not happy with their marriage. Therefore, he has filed the instant false FIR with vague and fabricated allegations levelled against the petitioner No.2. Counsel submits that both the petitioners are leading a happy married life, but in-spite of this their family members are not happy with their marriage and they are pressurizing the Police to apprehend the petitioner No.2 and

submit charge-sheet against him.

3. Public Prosecutor is not aware about the current factual

aspect of the matter, as stated by counsel for the petitioners.

4. Considering the arguments put forward by learned counsel for the petitioners, this Court deems it just and proper to dispose of the instant misc. petition directing the Investigating Officer to verify the factum of marriage alleged to be solemnized between the petitioners after recording the statement of the petitioner No.1 in particular and in case, the factum of marriage is found to be proved, then, the conclusion report under Section 173 Cr.P.C. be

submitted before the competent Court in accordance with law.

5. It is ordered that till submission of the conclusion report under Section 173 Cr.P.C., the petitioner No.2 shall not be arrested in connection with the FIR No.516/2014 registered with Police

Station Mahuwa, District Dausa.

6. The Investigating Agency would not keep the investigation pending and it is expected from the Investigating Officer to conclude the investigation and submit the conclusion report under

matter pertaining to the year 2014.

7. With the aforesaid observations/directions, the instant criminal misc. petition stands disposed of. The stay application and

all pending applications, if any, also stand disposed of.
