1. The present writ petition has been filed with the following

prayers:-

“(a) By an appropriate writ, order or direction the impugned transfer order dated 10.01.2026 (Ann.3) passed by respondent no. 2 may kindly be declared illegal, arbitrary, unjust and same may kindly be

quashed and set aside.

(b) By an appropriate writ, order or direction respondent no. 2 may kindly be directed to continue the petitioner on the post of School Lecturer (Hindi) at

Govt. Senior Secondary School, Kavtra, District Jalore (c) In alternate the respondents may kindly be directed to adjust the petitioner against the vacant post of School Lecturer (Hindi) in Block Sanchore, District Jalore in which the husband of petitioner is

posted.

(d) Any other appropriate writ, order or direction which this Hon'ble Court deems just and proper may kindly

be passed in favour of the petitioner.”

2. Brief facts of the case, as stated in the writ petition, are that the petitioner was appointed as a Lecturer and joined her duties at Government Senior Secondary School, Kavtra, District Jalore on 20.03.2021. Subsequently, respondent No. 2, vide order dated 10.01.2026, transferred as many as 1644 School Lecturers (Hindi), and in the said order, the petitioner was transferred from Government Senior Secondary School, Kavtra, District Jalore to Government Senior Secondary School, Arathwara, District Sirohi, without posting any substitute against her position. In pursuance of the said order, the petitioner was relieved from her post of Lecturer (Hindi) at Government Senior Secondary School, Kavtra, District Jalore on 28.02.2026. It is further contended that while passing the impugned transfer order, respondent No. 2 failed to take into consideration the applicable Government policy, which provides that employees working in different departments under the Government establishment should be posted within the same

district or at a nearby place.

3. Learned counsel for the petitioner at the outset submits that the respondent No.2 – Director, Secondary Education, Rajasthan, Bikaner may be directed to decide the representation of the petitioner taking into consideration the policy decision that as for

as possible, husband-wife shall be posted in the same District.

4. Learned counsel for the respondents does not oppose the

said prayer.

5. Thus, in view of the limited submissions made by learned counsel for the petitioner, the petitioner would be at liberty to

[2026:RJ-JD:14922] (3 of 3) [CW-5727/2026] submit a detailed representation to the respondents for ventilating her grievances within a period of ‘7 days’ from today and, in case, the same is submitted, the respondent No.2 - Director, Secondary Education, Rajasthan, Bikaner is directed to decide the same by way of passing a speaking order strictly in accordance with law within a period of ‘Two Weeks’ from the date of receipt of certified

copy of this order.
