1. Although, the matter is listed on interim applications filed by the petitioner yet, with the consent of the parties, the writ petition was heard finally. It is stated by learned counsel for the petitioner that the petitioner participated pursuant to advertisement No. 02/2025 dated 20.02.2025 for recruitment on the post of Patwari in the category of 'Specially Abled Person'; however, candidature of the petitioner was rejected vide order dated 30.12.2025 on the ground that the petitioner was medically unfit on account of being 49% disabled with Avescular Necrosis of

[2026:RJ-JP:12409] (2 of 3) [CW-446/2026] Right Hip. It is submitted that the aforesaid disability shown in the disability certificate produced by the petitioner was not interpreted in correct manner whereas, following reasons of disability were

given in the disability certificate:

“(A) He is a case of: LOCOMOTOR DISABILITY (B) The diagnosis in his case is AVN R HIP

(C) He has 40% (in figure) Forty percent (in words) PERMANENT physical impairment in relation to his RIGHT LEG (part of body) as per guidelines (to be

specified). “

On receipt of notices, the respondents filed additional affidavit dated 10.03.2026 in which, it was submitted that the initial medical certificate was since not clear therefore, the respondents vide letter dated 11.01.2026 requested the Superintendent, Group of Hospitals Ajmer and Principals Controller, Jawahar Lal Nehru Medical College, Ajmer for providing necessary guidance as to whether the disability Avescular Necrosis of Right Hip (49%) suffered by the petitioner falls within the category of OL (one leg)- (Lower Limb) or not. It has further been clarified in the additional affidavit that on such reference to the Medical Experts, an opinion dated 07.02.2026 has been received by the respondents wherein it has been clarified that the aforesaid disability suffered by the petitioner falls within the ambit of OL

(one leg)-(Lower Limb).

3. In view of above, where the respondents have themselves examined the petitioner and have found that the disability sustained by the petitioner comes within the parameter of consideration as prescribed in the advertisement, there remains no other reason for not considering the candidature of the

petitioner in the category of 'Specially Abled Person'.

[2026:RJ-JP:12409] (3 of 3) [CW-446/2026] 4. It has not been disputed that the petitioner has secured more marks than the marks declared for the particular category and he was rather selected by the respondents in the category of

'Specially Abled Person'.

5. In view of above, this Court deems it just and proper to allow the instant writ petition with directions to the respondents to consider candidature of the petitioner in the category of 'Specially Abled Person' and, in case, he is otherwise eligible, order of appointment shall be issued to appoint the petitioner on the post of Patwari along with consequential benefits within a period of 45

days from the date of receipt of certified copy of this order.
