1. The present writ petition has been filed by the petitioner challenging the construction of State Highway on Khasra No.85, Village Chakcharawas, Tehsil Neem ka Thana, District Sikar, on the ground that on account of construction of the said State Highway, the plot of the petitioner admeasuring 401.24 sq. yards would be

demolished.

Mr. Sunil Kumar Singodiya, learned counsel for the petitioner, submits that the petitioner has been residing over the said plot for many years and the same was purchased by him by way of an Agreement of Sale and he also has an electricity connection in his

favour.

3. Learned counsel further submits that the alignment of the said State Highway has been changed by the respondents only to benefit their blue-eyed persons and in case, the original alignment of the State Highway is maintained, the house of the petitioner

would not fall within the construction of State Highway.

4. Per contra, Mr. V.D. Gathala, learned Assistant Government Counsel and Mr. Dheeraj Tripathi, Advocate, appearing on behalf of respondents fervently submit that the development of Neemkathana-Khetri section of SH-13 from Km. 55+300 (at junction with SH-37B, Village-Sirohi) to Km. 102+450 (at junction with NH-311 at Jasrapur Mod near Khetri) in the District Neemkathana is being undertaken with loan assistance from the World Bank under Tranche-1 by PWD, Government of Rajasthan

through State Highway Authority (RSHA).

5. Learned counsel submit that the construction of the said State Highway would be of great significance for the development

of Neemkathana.

6. Learned counsel further submit that the allegation levelled by the petitioner with respect to change in the alignment of the said State Highway is wholly misconceived as there is no change in the alignment and the construction of the State Highway is being

made as was originally planned.

be dismissed.

8. Heard learned counsel for the parties and perused the

material available on record.

9. At the very outset, perusal of the record reveals that the petitioner has no valid title over the plot under question admeasuring 401.24 Sq. Yards in Khasra No.85, situated at Village Chakcharawas, Tehsil Neem Ka Thana, District Sikar. In absence of petitioner having any valid right and title over the said plot, he fails to establish any basis to challenge the construction of the said State Highway, much less so as to obstruct the construction of the said State Highway. It needs to be emphasized that construction and development of infrastructure is of paramount importance and cannot be stalled at the whims and fancies of an individual, more so when such an
