Order

02/04/2026

1. The instant writ petition has been preferred by the

petitioners seeking following reliefs :-

"(i) Issue an appropriate writ, order or direction for restraining the Respondents from plotting, auctioning, alienating, or commercially exploiting the land admeasuring 25,000 square metres and which was reserved for R.B.M. Hospital, Bharatpur in Scheme No. 10 of the Bharatpur Development Authority vide order

dated 31.12.2021, in any manner whatsoever; and (ii) Issue an appropriate Writ, order or direction to the Respondents to maintain and preserve the additional land falling under Scheme No. 10 admeasuring 25,000 square metres and adjacent to R.B.M. Hospital and allot the same to R.B.M. Hospital, Bharatpur for establishment of Radiotherapy Centre, Trauma Centre, Super Speciality

Centre and Nursing College,; and (iii) Issue an appropriate writ, order or direction to the Respondents to cancel and/or recall any alienation, sale allotment or auction of any part of land kept reserved or proposed to be kept reserved for RBM hospital by the Bharatpur Development Authority under Scheme No.

10; and (iv) Issue an appropriate Writ, order or direction to the Respondents to take immediate steps for allotment and utilization of the reserved land admeasuring 25,000 square meters and additional vacant land admeasuring 25,000 falling in Scheme No. 10, Bharatpur for expansion of RBM Hospital in accordance with law,

policy decisions, and budgetary announcements;

(v) Issue any other order, direction, declaration which Your Lordships deem just fit and proper in the facts and

circumstances of the case in favour of the petitioner;"

2. At the threshold, Mr. G.S. Gill, learned Additional Advocate General assisted by Ms. Shikha Sharma appearing the respondents-State has shown this Court a factual report dated
