1. Instant interim bail application has been filed on behalf of the applicant-accused for releasing him on interim bail for 30 days on ground of ailment of his wife, namely, Smt. Simran Mehra. The applicant-accused is being tried for an offence punishable under
Sections 8/15 and 29 of NDPS Act.
2. Learned counsel appearing for the applicant-accused contends that his wife is suffering from Urinary Tract Infection and Rt VUG Renal Calculus and the Medical Board has advised operation for kidney stone. Being a husband, applicant-accused is required to stay with his wife at the time of surgery. He has invited attention of the Court towards various medical record of wife of the applicant-accused. He further submits that in order to demonstrate his bona fides, applicant is prepared to deposit cash

petitioner may be granted benefit of interim bail for 30 days.
3. Per contra, learned Public Prosecutor has opposed the interim bail application asserting that there is a possibility that the applicant may flee and abscond if interim bail is granted to him. He thus, prayed that having regard to the gravity of offences alleged against the applicant-accused, the interim bail application
be rejected.
4. Under the orders of this Court, learned Public Prosecutor has placed on record medical report as well as family status report of applicant’s wife which are taken on record. The said reports fortify the averments of the applicant that the disease / ailment of his wife requires surgical intervention. It is also borne out from the family status report that there is no adult family member available
/ consenting to take care of applicant’s wife during her treatment.

Having heard learned counsel for the parties and upon consideration of the facts and circumstances of the case as well as on perusal of reports submitted by learned Public Prosecutor, it is found that applicant’s wife is suffering from Rt VUG Renal Calculus requiring immediate surgery and thus, she is in need of medical attention and care. Therefore, without expressing any opinion on the merits or demerits of the case, this Court deems it just and proper to grant interim bail to the applicant-accused for a period of 21 days, as no other family member is ready to take care of
applicant’s wife during her treatment.
6. Accordingly, interim bail application filed under Section 483 of BNSS is allowed and it is ordered that applicant-accused -

##PAGE3##[2026:RJ-JD:15224] (3 of 3) [CRLMB-15424/2025] Vikram Singh S/o Jogendra Singh ,arrested in connection with the above mentioned FIR, shall be released on interim bail for a period of 21 days, subject to the condition that the applicant- accused shall deposit Rs. 2,00,000/- (Two Lakhs Only) before the Trial Court and furnishes a personal bond in a sum of Rs. 4,00,000/- with two sound and solvent sureties in the sum of Rs. 2,00,000/- (out of which one surety will be of a close relative of the applicant-accused) each to the satisfaction of learned Trial Court for his surrender on completion
