1. The present writ petition has been filed with the following prayers:-
“(a) by an appropriate writ, order or direction the respondent department be directed to confirm the petitioners on the post of Veterinary Officer from the date of completion of two years of their initial appointment on urgent temporary basis; and (b) the respondent department be directed to count the past services of the petitioners on the post of Veterinary Officer on urgent temporary basis for the purpose of grant of pension/gratuity and other service emoluments as applicable to other regularly appointed Veterinary Officers;
(c) Grant such further relief(s) which in the facts and circumstances of this case may do complete justice to the petitioners; and (d) Costs of the writ petition be awarded to the petitioners.”
2. Brief facts of the case, as stated in the writ petition are that the petitioners had been working as Veterinary Officers on an urgent temporary/contract basis since around 2013, with their tenure being extended from time to time for nearly a decade. On 22.10.2019, the respondent initiated a recruitment process through the Rajasthan Public Service Commission (RPSC) for regular appointment to the post of Veterinary Officer. The petitioners participated in the selection process, successfully cleared the screening test and interview, and were thereafter called for document verification held between 16.08.2024 and 18.08.2024. Upon successful completion of all stages, their names were included in the final merit list, and appointment orders were issued on 10.09.2024. As per the conditions of appointment, candidates already working on an urgent temporary basis were required to tender resignation before joining the regular post. In compliance, the petitioners submitted their resignations, which were accepted by the respondent department, and they joined their new postings without any actual break in service.
