1. The instant writ petition has been filed with the following prayers:

“i) Issue an appropriate writ order or direction in the nature thereof thereby, the impugned order dated 10.01.2026 (Annex.1), Impugned Relieving order dated 14.02.2026 (Annex.2) passed by the respondents may kindly be quashed

and set aside ii) By issuing an appropriate writ, order or direction in the nature thereof, the Respondents may kindly be directed to continue the petitioner on the post of Lecturer (History), Govt. Senior Secondary School, Rahanawa Madhopura, District Sikar. iii) Pass any other appropriate order which this Hon'ble Court may deem fit, just and proper in the facts and circumstances of

the case in favour of the Petitioner.”

2. The present writ petition challenges the impugned transfer order dated 10.01.2026, whereby the petitioner, a Lecturer (History), has been transferred from Shahid Dayachand Government Senior Secondary

[2026:RJ-JD:15129] (2 of 3) [CW-6054/2026] School, Rahanawa Madhopura, District Sikar (rural area) to Mahatma Gandhi Government School, Chhapra, Jhunjhunu, without any administrative exigency and without selection, while Respondent No. 4, Iqbal Khan, has been posted in her place despite being lower in the merit list (petitioner at Sr. No. 719 and Respondent No. 4 at Sr. No. 811). Further, the petitioner, who has an unblemished service record, has been relieved on 14.02.2026 and transferred during the ban period and mid-academic session, when Board examinations were ongoing, thereby adversely affecting the educational environment. Further, the transfer to a Mahatma Gandhi English Medium School is stated to be in violation of Rule 10 of the Rajasthan Civil Services (Special Selection and Special Conditions of Service for Appointment of Personnel in the English Medium Schools) Rules, 2023, as the petitioner has experience only in Hindi medium teaching. Additionally, it is submitted that the petitioner’s husband is also a government Lecturer posted in District Sikar, and as per the State policy and judicial precedent, spouses should be posted at the same station; however, this aspect has been ignored

by the respondents. Hence the writ petition.

3. Learned counsel for the petitioner submits that, during the period when a transfer ban was in operation, the respondents transferred the petitioner from Sikar to Jhunjhunu. He further submits that both the petitioner and her husband are working on the post of Lecturer, which is a transferable post outside the district. At the outset, learned counsel prays that Respondent No.2– Director, Secondary Education, Rajasthan, Bikaner, may be directed to consider and decide the petitioner’s representation in light of the policy decision of the State Government, which provides that, as far as possible, husband and wife should be

posted in the same district.
