By way of filing the present writ petition under Article 226 of
the Constitution of India, the petitioner has prayed for the
following reliefs:

“It is, therefore, humbly and respectfully prayed that this writ petition of the petitioner may kindly be allowed and
by an appropriate writ, order or direction:
(i) the impugned order dated 25.11.2025 (Annexure-3) to the extent it mentions the total cost as Rs.26,91,986/-, subsidy (Dey Anudan) Rs. 16,59,840/-, as and petitioner's contribution as Rs. 10,32,146/-, may kindly be quashed and
set aside, qua the petitioner (ii) the respondents may kindly be directed to forthwith revise (the administrative approval order dated 25.11.2025- Annex.3 qua the petitioner) and accordingly reissue the administrative approval order in favour of the petitioner, calculating the Rs.19,19,424/- based on the rate of Rs.769/- per total cost at square meter as per the guidelines dated 04.06.2020 (Annexure-4), and granting 95% subsidy amounting to Rs. 18,23,453/ with the petitioner's contribution as Rs.95,971/-, in accordance with the Guidelines/Instructions (2023-2024) for the Mission for
Integrated Development of Horticulture (Annexure-5).
(iii) Any other relief, which this Hon'ble Court deems fit, just and proper, by which the petitioner may get complete justice
may also kindly be passed.
(iv) Writ petition filed by the petitioner may kindly be allowed with exemplary costs..”

After arguing the matter for sometime, learned counsel for the petitioner submitted that the petitioner would be satisfied if the competent authority of the respondent - department is directed to consider and decide the representations dated 14.12.2025 and 07.02.2026 submitted by the petitioner seeking 95% subsidy for construction of Poly House in accordance with law
as expeditiously as possible.
3. In view of the aforesaid limited submission made at Bar by the learned counsel for the petitioner, the present writ petition is disposed of with a direction to the competent authority of the respondent – department to consider and decide the representations dated 14.12.2025 and 07.02.2026 submitted by the petitioner seeking 95% subsidy for construction of Poly House as expeditiously as possible preferably within a period of four weeks from today keeping in view the applicable review guidelines
in accordance with law.

It is made clear that the aforesaid direction to decide the representations has been issued only with a view to ensure expeditious redressal of the petitioner’s grievances and the same may not be construed to an order to decide the representation in a
particular manner.
