1. The present criminal writ petition has been filed by a non- governmental organization seeking various directions, including a proper investigation into registered FIRs and the alleged illegal stay of foreign nationals in the Ashram. The petition also expresses concern for the safety, security, dignity, and well-being of His Holiness Vishwaguru Mahamandleshwar Paramhans Swami Maheshwarananda, who is 81 years old, and seeks a direction to provide him with appropriate medical treatment.

2. It appears from the pleadings that there are cases and counter-cases among the diciples of Swami Ji. Based on complaints from such diciples, FIRs were issued by the concerned police authorities; the apprehension of the petitioner-Organization is that no proper investigation is being conducted into the said FIRs.

Learned counsel appearing on behalf of the petitioner- Organization contended that Swami Ji was being drugged and that his health was deteriorating due to various illegal activities occurring within the Ashram. In light of these circumstances, this Court constituted a Medical Board to examine Swami Ji’s condition.

4. According to the report of the Medical Board, Swami Ji is suffering from age-related medical problems. There is nothing in the medical report to suggest that Swami Ji was drugged. The report further indicates that Swami Ji is receiving medical treatment and no unusual findings were noted, except for expressive aphasia with cognitive dysfunction; there are no signs or symptoms of neurological or psychological disorders.

5. The Medical Board’s report prima facie demolishes the petitioner-Organization’s claim that Swami Ji was drugged. Furthermore, regarding the allegation of improper inquiry by the police authorities, the actual complainants are not before this Court. The petitioner-Organization, not being a complainant, has nothing to do with the registered criminal cases. A third party cannot be allowed to interfere in criminal proceedings. If there is a grievance regarding an improper investigation, it must be espoused by the concerned complainant rather than a third party to the proceedings.

6. There is also an allegation regarding financial irregularities. However, there is nothing on record to prima facie support the alleged financial mismanagement of the Ashram. In fact, it appears from the petitioner-Organization’s own statements that a legally constituted Trust exists.

7. In view of the aforesaid, the present criminal writ petition appears to be misconceived and is liable to be dismissed.

8. Accordingly, the present criminal writ petition is dismissed with costs of Rs. 5 lakhs, payable by the petitioner organization to the Rajasthan State Legal Services Authority, Jodhpur.

9. Since the criminal writ petition itself is dismissed, the applications filed by applicants for the impleadment of parties are also rejected.

10. Accordingly, all pending application(s), if any, shall stand disposed of.
