Where parties agree that the legal issues in the current matter are identical to those decided in a previous judgment by a Co-ordinate Bench, the Court may dispose of the petitions by following the directions issued in that prior decision.

Headnote:(A) Judicial Precedent - Principle of stare decisis - Where counsel for parties agree that the issue is fully covered by a previous decision of a Co-ordinate Bench, the writ petitions are to be disposed of in terms of the directions issued in that earlier judgment. (Paras 1 and 2)

Facts of the case:
Multiple writ petitioners filed petitions seeking redress regarding recruitment or service matters under the State Education Department and the Public Service Commission. The parties were in consensus that the legal issues raised in these petitions were identical to those addressed in a prior judgment by a Co-ordinate Bench.

Findings of Court:
Upon receiving the consensus from both sides regarding the applicability of the precedent, the Court disposed of all connected petitions in accordance with the directions set out in the cited case.

Issues: Whether the grievances raised in the current writ petitions are governed by the legal ratio laid down in a previous decision of the Court regarding similar service-related matters.

Ratio Decidendi: When parties reach a consensus that the controversy is already squarely covered by a past binding or persuasive judgment, the Court may dispose of the matters by applying those same directives without re-adjudicating the merits.

Result: Petitions disposed of.

1. Learned counsel for the parties are in complete agreement that the issue involved in these writ petitions is covered by order dated 25.11.2025 passed by Co-ordinate Bench of this Court in the case of Priyanka Kumari Sharma Vs. Rajasthan Public Service Commission (S.B. Civil Writ Petition No.18240/2025) decided on 25.11.2025.

2. In view of consensus arrived at between learned counsel for the parties, these writ petitions are disposed of with the same directions as given by Co-ordinate Bench of this Court in the case of Priyanka Kumari Sharma (supra).

3. Pending application(s), if any, stand(s) disposed of.
