1. This civil writ (PIL) petition has been preferred claiming the following reliefs:

“It is, therefore, respectfully prayed that record of the case may be called for by an appropriate writ, order or direction:

(i) The respondent authorities may be directed to take appropriate measures in regard to immediately stop the construction of Transmission Line (400 kV D/c transmission line from Fatehgarh 3 to Badla 3) [Fatehgarh III Transmission Limited], which is proposed to be passed over the inhabited area including village school of Village Bappi ki Dhani (Kheerva), Panchayat Samiti Bap, Phalodi.

(ii) Further, the respondent authorities may kindly be directed to reconsider/review the approval, if any, granted under Section 164 of the Electricity Act for construction of transmission line and its decision making process, to the extent of the inhabited area including village school of Village Bappi ki Dhani (Kheerva), Panchayat Samiti Bap, Phalodi.

(iii) Any other relief to which the petitioner is entitled, may be granted in his favour.

(iv) The writ petition may be allowed with costs.”

2. Learned counsel for the petitioner submitted that the transmission tower in question is very near to the school premises and could jeopardise the safety of the children.

3. Learned counsel for the respondent submits that these are transmission lines of 400 kV D/c transmission being laid down from Fatehgarh III to Badla III.

3.1. Learned counsel further submits that all requisite statutory approvals have been duly obtained and the prescribed safety parameters have been strictly adhered to. It is submitted that as per the applicable norms, a minimum distance of 23 meters from either side of the boundary of the school is required to be maintained, whereas in the present case, the distance from one side is approximately 45 meters, which is substantially more than the prescribed safety requirement. It is further submitted that the project comprises 584 towers, out of which 476 foundations have been completed and 371 towers have already been erected, covering approximately 96.6 circuit kilometers, and all applicable norms are being duly complied with.

4. This Court has considered the submissions made at the Bar and has examined the material available on record. This Court finds that the respondent authorities have complied with the requisite statutory provisions and have obtained all necessary permissions in accordance with law. This Court further finds that the prescribed safety norms, including the minimum distance requirement, have been duly adhered to. Thus, at this juncture, the PIL does not survive.

5. Accordingly, the civil writ (PIL) petition is dismissed.
