1. Apprehending his arrest in connection with FIR No.474/2011 registered at Police Station-Anti Corruption Bureau, District-Jaipur for the offences under Sections 13(1)(c)(d)(2) of the Prevention of Corruption Act, 1988 and Sections 420, 467, 468, 471 and 120-

B of IPC.

2. Heard learned counsel for the petitioner as well as learned

Public Prosecutor and perused the material available on record.

3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that the FIR was lodged in the year 2011 and that the petitioner has retired from service in year 2017. He also submits that on the

[2026:RJ-JP:13873] (2 of 3) [CRLMB-3399/2026] same set of allegations, the co-accused namely Ramhari Meena, Guman Singh, Bhuvnesh Kumar and Bhuvnesh Mathur have already been granted benefit of anticipatory bail by a Co-ordinate Bench of this Court vide order dated 26.09.2025. He further submits that the petitioner is ready and willing to cooperate with the investigation. Hence, the bail application of the petitioner may

be allowed.

4. Learned Public Prosecutor has vehemently opposed the bail

application.

5. Mr. Gyanchand, Dy. SP, ACB, the Investigating Officer, is present in Court and submits that the petitioner is no longer required, as the investigation has been completed and the charge

sheet has already been filed.

6. Considering the fact that the petitioner is ready and willing to co-operate with the investigation of the case and as per version of the Investigating Officer but without commenting anything on the merits/demerits of the case, I deem it just and proper to allow the

bail application of the petitioner.

7. Accordingly, the bail application under Section 482 BNSS is allowed and it is ordered that in the event of arrest of the petitioner-Ashok Kumar Gupta S/o Shri Hulasi Ram, he shall be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned

Police Station on the following conditions:-

(i) that the petitioner shall make himself available for

interrogation by a police officer as and when required;

to the court or any police officer, and

(iii) that the petitioner shall not leave India without previous

permission of the court.
