Order

1. This second bail application under Section 483 of BNSS has been filed by the petitioner who has been arrested in connection with F.I.R. No.507/2024 registered at Police Station Sadar Sriganganagar, District Sriganganagar, for offences under Sections the offences under Sections 109(1), 126(2), 351(3), 115(2), 189, 49 of BNS.

Learned counsel for the petitioner submitted that the allegations against the petitioner are that he inflicted injuries upon the injured persons, namely, Harvindra Singh and Balveer Singh, with a sharp-edged weapon (sword). It is submitted that the injuries allegedly caused by the petitioner to Harvinder singh are grievous in nature and dangerous to life. Learned counsel further submitted that co-accused persons, namely, Krishna Rajput @ Chindra Pal, Pawan Kumar and Balvindra Singh @ Bittu (S.B. Criminal Appeal (SB) No. 1775/2024), have already been enlarged on bail by this Court vide order dated 09.01.2025.

3. Learned counsel submitted that the statements of the injured persons, namely, Harvindra Singh and Balveer Singh, have already been recorded before the competent Criminal Court and, therefore, there is no apprehension of the petitioner influencing them.

Lastly, learned counsel submitted that the petitioner has been in judicial custody since 07.10.2024 and, till date, out of a total of 37 cited prosecution witnesses, statements of only 3 witnesses have been recorded before the competent Criminal Court. Thus, the trial is likely to take a considerable amount of time. On these grounds, he prayed that the petitioner be enlarged on bail.

5. Heard learned counsel for the petitioner as well as the learned Public Prosecutor, and perused the material available on record.

6. Per contra, learned Public Prosecutor has vehemently opposed the bail application. However, he was not in a position to dispute the fact that the aforesaid co-accused persons have already been enlarged on bail by this Court. He was also not in a position to dispute that the statements of the injured persons, namely, Harvindra Singh and Balveer Singh, have already been recorded before the competent Criminal Court, and therefore, there is no likelihood of the petitioner influencing the material prosecution witnesses.

7. Having considered the rival submissions, facts and circumstances of the case, without expressing any opinion on merits/demerits of the case, this Court is inclined to enlarge the petitioner on bail.

8. Consequently, the second bail application under Section 483 of BNSS is allowed. It is ordered that the accused-petitioner Vicky Gill S/o Kewal Singh arrested in connection with F.I.R. No.507/2024 registered at Police Station Sadar Sriganganagar, District Sriganganagar, shall be released on bail, if not wanted in any other case, provided he furnishes a personal bond of Rs.50,000/- and two sureties of Rs.25,000/- each, to the satisfaction of learned trial court, for his appearance before that court on each & every date of hearing and whenever called upon to do so till completion of the trial.

9. It is however, made clear that findings recorded/observations made above are for limited purposes of adjudication of bail application. The trial court shall not get prejudiced by the same.
