HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR
Anand Sharma, J
KHUSHPENDRA DAVE – Appellant
Versus
STATE OF RAJASTHAN – Respondent
S.B. Civil Writ Petition No. 8208/2026
For the Appellants/Petitioners: Harish Purohit
For the Respondents: Khet Singh Rajpurohit
A candidate has no vested right to repeated rescheduling of an interview date; such requests are discretionary. Furthermore, significant unexplained delay in approaching the court after a rejection demonstrates a lack of bona fides, justifying the dismissal of the petition.
Headnote:(A) Recruitment Process - Interview Scheduling - Discretionary Power - A candidate's request to change the date of an interview is subject to the discretionary power of the recruiting agency; repeated requests for rescheduling based on personal convenience do not confer a vested right upon the candidate. (Para 9)
(B) Writ Jurisdiction - Laches and Bona fides - Unreasonable delay in approaching the court after the rejection of a request, particularly when the recruitment process is nearing completion, indicates a lack of bona fides and disentitles the petitioner from seeking discretionary relief. (Para 10)
Issues: Whether the petitioner is entitled to a further rescheduling of the interview date after a previous accommodation was granted and whether the delay in filing the writ petition affects the claim.

Order
1. This writ petition has been filed by the petitioner seeking direction against the respondents to permit the petitioner for appearing in an interview, which is being conducted by the respondent pursuant to Rajasthan State and Subordinate Services Combined Competitive Examination- 2024.
2. It is submitted that the petitioner on being eligible, participated in the recruitment process of aforesaid examination and he qualified the preliminary examination. Thereafter, since he acquired sufficient marks, he was further permitted to appear in interview vide letter dated 24.11.2025, whereby, petitioner was called for interview on 04.12.2025 at 12.45 p.m. at the designated place.
3. Learned counsel submits that since before the date of interview, the petitioner met with an accident on account of slipping from his Scooty, therefore, he made a request before the competent officer of RPSC for re-scheduling his date of interview.
4. Request made by the petitioner was acceded by RPSC and new date of 10th December, 2025 was assigned for interview of the petitioner.
5. Learned counsel submits that even by the re-scheduled date of interview, the petitioner could not recover, therefore, on 9th December, 2025, he again made a request for providing next date for his interview. The request made by the petitioner was rejected by the RPSC on 09.12.2025 itself.
6. Learned counsel submits that the petitioner has acquired sufficient marks and suitable place in the merit list prepared by RPSC and as such is a meritorious candidate, therefore, the petitioner could not be deprived of his legitimate right to participate in the interview process, only for the reason that he could not avail the earlier scheduled dates on account of his physical constraints. Learned counsel submits that the last round of interview is going to be completed on 17.04.2026, therefore, RPSC be directed to permit the petitioner to appear in interview, otherwise, petitioner would suffer serious prejudice and miscarriage of justice.
7. Learned counsel appearing for respondent – RPSC seriously opposed the writ petition, and submitted that conduct of the petitioner disentitles him from seeking any relief whatsoever in the instant writ petition. It is submitted that the facts stated in the writ petition itself would reveal that the RPSC has also considered the request made by the petitioner and date of interview was re- scheduled from the 4th of December, so as to provide sufficient time to the petitioner to come out of immediate shock of alleged accident and to appear before the interview Board. Learned counsel submits that petitioner has utterly failed to place any concrete evidence on record to show that the injuries sustained by him were of such nature that he was not even in position to appear before the interview Board. Otherwise also, the second request made by the petitioner for re-scheduling the date of interview was rejected by the RPSC on 09.12.2025 itself, but the petitioner has waited for more than four months for approaching this Court to seek a prayer of rescheduling the date of interview and now, at the fag end, when the entire process is about to complete on 17.04.2026, malafidely the instant writ petition has been filed. In case, such tactics of a candidate not to comply with the schedule of interview is permitted, it would ruin the entire recruitment process and would unsettle the process of the recruiting agency. For the aforesaid reasons, he prayed for dismissal of the writ petition filed by the petitioner.
