The Court disposed of multiple connected writ petitions by applying the ratio and terms of the judgment delivered in DBSAW No.1111/2024 (State of Rajasthan & Anr. Vs. Vijay Kumar Joshi & Ors.), based on the agreement of the counsel for both parties.

Issues: Whether the present writ petitions can be disposed of in terms of a precedent decided by the same court on the same date. (A) Judicial Precedent - Application of Prior Judgment - Where parties agree that the controversy is covered by a judgment delivered by the same court in a similar matter, the petitions are liable to be disposed of in the same terms. (Para 1, 2)

Order

Learned counsel for the parties are in agreement that the controversy involved in the present cases is squarely covered by the judgment of even date rendered by this Court in DBSAW No.1111/2024 (State of Rajasthan & Anr. Vs. Vijay Kumar Joshi & Ors.) and, therefore, the present writ petitions may be disposed of in same terms.

In view of the submissions so made by learned counsel for the parties, the present writ petitions are disposed of in terms of the order passed in Vijay Kumar Joshi’s case (supra).

The stay application and all other pending applications, if any, shall stand disposed of.
