Order

1. Petitioner has filed the instant writ petition with following prayers:

“It is therefore most humbly and respectfully prayed on behalf of the petitioner that the writ petition may kindly be allowed and by an appropriate writ, order or direction;-

I. The respondent department may kindly be directed to grant promotion to the petitioner to the post of Joint Director with retrospective effect, along with all consequential benefits;

II. The respondent department may kindly be directed to fix the seniority of the petitioner in the cadre of Joint Director at the appropriate place above his juniors, in accordance with his due date of promotion.

III. The respondent department may kindly be directed to granted all monetary benefits, including arrears of pay, allowances, and revision of pensionary benefits, arising out of such retrospective promotion with interest @ 9% per annum (or any higher rate as deemed fit by this Hon’ble Court) on the delayed payment of arrears and other monetary from the date the same became due till actual payment;

IV. Any other appropriate writ, other or direction which this Hon’ble Court considers just and proper in the fact and circumstances of the case may kindly be passed in favor of the petitioner.

V. Cost of the writ petition may kindly be awarded to the petitioner.”

Learned counsel for the petitioner submits that on account of certain adverse remarks entertained in the Annual Confidential Report (for short, ‘ACR’) of the petitioner, earlier the petitioner was deprived of consequential benefits, therefore, petitioner challenged the adverse remarks by way of filing S.B. Civil Writ Petition No.7533/2020 (Dr. Sanjeev Kumar Das Vs. State of Rajasthan & Ors.), which is still pending before this Court.

3. Learned counsel for the petitioner also submits that the petitioner is at the verge of retirement, however, benefit of promotion on the post of Joint Director has not been given to him.

4. Learned counsel for the petitioner further submits that the petitioner would be satisfied, in case, the present writ petition is disposed of with liberty to the petitioner to submit a representation before the respondents for redressal of his grievances.

5. In view of limited prayer made by learned counsel for the petitioner, this Court deems it just and proper to dispose of the present writ petition with liberty to the petitioner to submit a representation before the respondents, who shall consider and decide the representation within a period of 60 days from the date of receipt of representation along with a certified copy of this order strictly in accordance with law.

6. Accordingly, the present petition stands disposed of.

7. It is made clear that this Court has not expressed any opinion on merits of this case.

8. Pending application(s), if any, also stand(s) disposed of.
