Bail may be granted to an accused when the investigation is complete, the accused has no past criminal record, and the trial is expected to continue for a significant duration, provided the court finds it appropriate in the totality of the circumstances.

Facts of the case:
The petitioner sought bail regarding an FIR registered under the Bharatiya Nyaya Sanhita, 2023 for alleged assault. The complainant reported that an unknown person entered their residence and injured them. The petitioner was subsequently arrested and identified by injured witnesses during trial court testimony. The petitioner contended that there was prior animosity, that the medical injury report contradicted the oral testimony regarding the weapon used, and that the initial FIR was against an 'unknown person' despite the complainant's claim of identification.

Findings of Court:
The Court observed that while the prosecution opposed the bail based on the gravity of injuries, the petitioner had been in custody for nine months, the investigation was complete with the charge-sheet filed, and there were no prior criminal antecedents. Without opining on the merits, the Court concluded that the protracted nature of the trial justified granting bail.

Issues: Whether the petitioner should be enlarged on bail despite the serious nature of the offences, specifically considering his duration of custody, the filing of the charge-sheet, and his lack of criminal antecedents.

Ratio Decidendi: Where the investigation is complete, the petitioner has no criminal history, the trial is expected to take a significant amount of time, and the accused has already served a substantial period in custody, bail may be granted noting the totality of circumstances.

Result: Application allowed and bail granted.

Order

This third application for bail under Section 483 of BNSS (439 Cr.P.C.) has been filed by the petitioner who has been arrested in the present matter. The requisite details of the matter are tabulated below:

The 2nd bail application filed on behalf of the petitioner, i.e. S.B. Criminal Misc. Bail Application No.12147/2025 was dismissed vide order dated 10.11.2025, passed by this Court with the liberty to the petitioner to file a fresh bail application after recording the statement of injured Amraram and Papli Devi. After rejection of the second bail application, the statements of Amraram and Papli Devi have been recorded before the trial court, deposed as PW-03 and PW-04, respectively. Hence, this third bail application has been filed.

Learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this matter.

It is further submitted that both the injured witnesses, examined as P.W-03 and P.W-04, in their statements recorded before the learned Trial Court, have categorically deposed that at around midnight, an unknown man trespassed into their residence, whom they immediately apprehended and identified as one Rahul Singhariya. Notwithstanding the specific identification of the petitioner by the injured persons themselves, the FIR was registered against an unknown person and not against the present petitioner. It is submitted that this raises serious doubt and indicates a deliberate suppression of material facts in the registration of the FIR, which was, in any event, lodged after an unexplained delay of more than 24 hours. The relevant portion of the statement of the injured Amraram, recorded before the trial court, deposed as P.W-03, is reproduced below:

मेरे एक बच्चा है, जिसका नाम दिनेश है व दो लडकिया है, जिनके नाम प्रेम व तरूणा है। मेरी बेटी तरूणा कक्षा आठवी में पढ़ती थी। राहुल सिंघाडिया ने मेरी पुत्री के साथ छेडछाड की तो मेरी पुत्री ने मुझे उक्त बात बताई थी। तब मैंने राहुल के माता-पिता को ओलबा दिया था। जिस पर उसके माता-पिता ने कहा कि मेरा बेटा राहुल आज के बाद यह गलती नहीं करेगा। मेरी पुत्री तरूणा व पुत्र दिनेश का रिश्ता आमने-सामने किया था। फरवरी 2025 में वो रिश्ता टूट गया था। उसके बाद राहुल मेरी पुत्री के साथ छेडछाड करता था। शादी के बाद मेरी पुत्री को मैने उसके ससुराल भेज दिया था। मेरी पुत्री को राहुल मोबाईल पर मैसेज भेजता था। उपरोक्त घटना दिनांक 19.06.2025 की है। रात को 10 पीएम पर मैं, मेरी पत्नी पपलीदेवी, मेरे पिताजी लाबुराम व मेरी पुत्री तरूणा खाना खाकर सोने के लिए गये थे। मेरे पिताजी गेट के बाहर सो रहे थे। मैं व मेरी पत्नी घर की छत पर सोये हुए थे। मेरी पुत्री तरूणा नीचे कमरे में सो रही थी। मुझे रात को 10-10.30 पीएम पर नींद आ गयी थी। तभी रात को लगभग 1-2 बजे के बीच में राहुल सिंघाडिया मेरे ार की छत पर आकर लोहे का गेट खोलने लगा। जिसकी आवाज हमें सुनाईदेने पर हमारी आंख खुल गयी। तभी मैंने कौन है-कौन है कहकर उसे पकडा तो मेरी पत्नी की उस समय आंख खुली तो उसने भी आकर राहुल को पकड लिया। तब राहुल ने मेरे छत पर पडी लकडी से मेरी पत्नी के साथ मारपीट करने लगा तो लकडी बिखर गयी फिर राहुल ने अपने पेंट की जेब से लोहे की क्लिप निकालकर जान से मारने की नियत से मेरे व मेरी पत्नी के सिर पर मारी। जिससे मेरे व मेरी पत्नी के सिर पर चोटे आई। फिर हमारे खून आने लगा जिससे मेरे पहने हुए कपडे व बिस्तर तथा छत्त व दीवारों पर खून के छींटे पडे। मै चिल्लाया तो मेरी पुत्री तरूणा व मेरे पिताजी आए तथा मेरी व मेरे पत्नी की देखभाल की तभी राहुल मौका देखकर पडोस के मकान होते हुए वहां से भाग गया। राहुल के उस समय काले रंग का टीशर्ट व काले रंग की पेंट व बुट पहने हुए थेl
