1. The petitioner has filed this interim bail application under Section 483 of BNSS in FIR No323/2021 registered at Police Station Weir, District Bharatpur for offence under Section 363 of
the IPC, 1860
2. Heard learned counsel for the petitioner, learned Public Prosecutor as well as learned counsel for the complainant and
perused the material available on record.
3. Learned counsel for the petitioner submits that the petitioner is in judicial custody in connection with the aforesaid case. The present interim bail application has been preferred on the ground of the marriage of the niece of the petitioner, which is going to be solemnized on 19.04.2026. The sole ground for seeking interim

##PAGE2##[2026:RJ-JP:16349] (2 of 3) [CRLMB-5510/2026] bail is that the petitioner being the uncle is the only responsible male member of the family and is required to perform all the rituals, arrangements and ceremonial obligations relating to the marriage. His absence from the said marriage would cause irreversible hardship to the family. It is therefore, prayed that the petitioner may be granted interim bail for a period of 15 days. It is further submitted that the petitioner shall surrender himself immediately after expiry of the interim bail period and shall not
misuse the liberty so granted.

Learned Public Prosecutor and learned counsel for the complainant have vehemently opposed the interim bail application of the petitioner and submitted that the present petitioner is involved in the murder of a child aged about two years. Learned Public Prosecutor has produced the verification report of the concerned SHO which confirms the factum of the marriage of the petitioner’s niece. However, the said report also discloses that apart from the petitioner there are two other real brothers of the petitioner including the father of the bride. It is further submitted that the report reveals that there are approximately nine adult male members (sons of the petitioner’s real brother) available to share the responsibilities and perform the necessary arrangements for the marriage. Hence, the interim bail application is liable to be
dismissed.

Having considered the submissions made by the learned Public Prosecutor and upon perusal of the material available on record, this Court is of the view that the petitioner is facing charges for the commission of murder of a child aged about two years which is a grave and serious offence. Therefore, in view of the aforesaid factual matrix, this Court is not
inclined to grant the benefit of interim bail to the petitioner.
6. Hence, the interim bail application stands dismissed.
