HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR
Munnuri Laxman, J
KALU RAM JAT S/O-SHRI MALI RAM JAT – Appellant
Versus
STATE OF RAJASTHAN – Respondent
S.B. Civil Writ Petition No. 7650/2026

Advocates:
For the Appellants/Petitioners: Naveen Dhuwan
For the Respondents:

The court held that experienced manpower sponsored through an agency should be continued through any newly selected agency to prevent loss of service and utilize existing experience for the department's benefit.

Headnote:(A) Employment - Manpower Agency - Termination due to expiry of agency contract - Protection of experienced personnel - Direction to sponsor existing experienced workers through a new agency to avoid deprivation of service and benefit the department. (Para 4, 5)

Issues: Whether the petitioners should be continued in service through a new manpower agency upon the expiry of the previous agency's term.

Table of Content
1. petitioners seek protection from termination resulting from the expiry of their sponsoring manpower agency's contract. (Para 1 , 2 , 3)
2. the court recognizes the value of long-standing experience in manpower services over the engagement of fresh candidates. (Para 4)
3. interim direction to ensure continuity of service through any newly appointed manpower agency during the pendency of the petition. (Para 5 , 6 , 7)

Order

1. Heard on the stay application.

2. The submission of learned counsel for the petitioners is that the petitioners are working on various posts sponsored through the Medical Relief Society, which is a manpower supplying society. By the impugned termination order dated 06.03.2026 (Annexure- 5), the services of the petitioners were sought to be discontinued on the ground that the term of the Society, through which they were sponsored, has expired and the respondents want to proceed with the bidding process to select a new manpower agency.

3. The apprehension of the petitioners is that if a new manpower agency is selected in place of the existing Society in the bidding process, the services of the petitioners may not be sponsored by the new entity, thereby depriving them of continuation of their service.

4. This Court feels that the petitioners have sufficient experience by virtue of their long-standing work and if the Society under which the petitioners were sponsored is changed and a new entity is selected in place of the Society, the petitioners' candidature should be sponsored through the new entity instead of engaging fresh candidates, which will also be advantageous to the respondent Department.

5. In view of the above, the respondents are directed to continue to obtain the services of the petitioners, in the event a new entity is enlisted for sponsoring the manpower to work for the respondents and their services shall be sponsored through the new entity during the pendency of this writ petition.

6. Issue notice to the respondents, returnable within a period of four weeks.

7. List the matter on 02.07.2026
