1. These bail applications under Section 483 of BNSS have been filed on behalf of the petitioners, who have been arrested in connection with FIR No.5/2026 registered at Police Station Mokhampura, District Jaipur Rural (Rajasthan) for offences punishable under Sections 318(2) & 316(2) of the Bharatiya Nyaya Sanhita, (in short ‘BNS’) 2023. During investigation offences punishable under Sections 338, 336(3), 340(2) & 61(2) of BNS

have also been added against the petitioners.

2. Learned counsel for the petitioners submit that petitioners have falsely been implicated in this case. Counsel submit that seven other FIRs of similar allegations have also been registered against the petitioners. Counsel submit that co-ordinate Bench of this Court as well as this Court have granted benefit of bail to the petitioners in some of the cases registered against them. Counsel submit that alleged offences are triable by Magistrate. It is submitted that petitioners Ranveer Sharma and Vishwambhar Dayal Sharma are in custody since 21.01.2026 whereas petitioner Arun Sharma is in custody since 30.01.2026 and trial will take considerable time in its conclusion and further custody of the

petitioners would not serve any fruitful purpose.

3. Learned State Counsel opposes the bail applications. She submits that several other cases have been registered against the

petitioners.

4. I have considered the contentions.

Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioners, especially the fact that alleged offences are triable by Magistrate, as also the fact that petitioners have been granted benefit of bail in other cases by co-ordinate Bench of this Court as well as this Court and trial will take considerable time in its conclusion as well as looking to the custody period, but without commenting anything on the merits/demerits of the case, I deem it fit and proper to allow

these bail applications.

6. These bail applications are accordingly allowed and it is directed that accused-petitioner – (1) Ranveer Sharma S/o Late Shri Sundarlal, (2) Vishwambhar Dayal Sharma S/o Shri Sohan Lal Sharma & (3) Arun Sharma S/o Brijesh Kumar Sharma shall be released on bail provided, each of them furnishes a personal bond in the sum of Rs.1,00,00
