1. This third bail application under Section 483 of BNSS is filed by the applicant-accused Suraj Pratap Mawai S/o Lokendra Singh seeking bail in respect of a criminal case registered as FIR No. 464/2025 dated 16.08.2025 registered at P.S. Kotwali District – Dholpur, for the offence under Sections 189(2), 115(2), 126(2), 125, 303(2), 352, 351(2), 351(3) of BNS.

2. Learned counsel for the applicant submits that the applicant has been falsely implicated in the matter and the investigation against him is complete and he is no more required in investigation. He further submits that there are no chance of fleeing of applicant accused from the jurisdiction of this Hon’ble Court. He also submits that the applicant undertakes not to repeat offence and cooperate with investigation/trial, which will take time.

3. Learned counsel for petitioner submits that first bail application of present petitioner was dismissed on 17.9.2025 and second bail application on 17.11.2025. He also submits that four cases out of nine have already been disposed of and petitioner was acquitted from the charges. He referred criminal cases arising out of FIR No. 443/2015, 427/2015, 54/2020 and 260/2018 to submit that the petitioner has been acquitted in these cases. He further submits that the petitioner is in custody and other persons were already released on bail.

4. Learned Public Prosecutor and learned counsel for complainant have vehemently opposed the bail application and submitted that the allegations are grave and serious in nature. Learned counsel for complainant has submitted the petitioner is having criminal background and release of petitioner would jeopardise the safety of victim.

5. Heard learned counsel for the petitioner-accused and learned Public Prosecutor and learned counsel for complainant.

Perused the material placed on record by both the parties.

6. On 17.9.2025, this court has granted bail to Hemant Sharma, Rajkumar and Shiva involved in the incident but dismissed the bail application of present petitioner as withdrawn. Second bail application of present petitioner was dismissed by this court on 17.11.2025. Now the counsel for petitioner has filed on record four judgments to show that out of nine criminal cases registered against the petitioner, petitioner has secured acquittal in four cases and five criminal cases, including present one, is pending against the petitioner.

7. Having considered the fact that the petitioner is in custody for quite some time and three persons have already been granted bail, therefore it is appropriate to consider bail application of present petitioner with some conditions.

8. Upon hearing the arguments and perusing the record, we have found that the applicant-accused is no more required in the investigation and he is in custody for quite some time. The further proceedings will take its own time, therefore, looking to entirety of facts and circumstances of the case and without expressing any opinion on merits of the case, the Court deems it appropriate to grant bail to the applicant-

accused.

9. Thus, the third bail application filed on behalf of applicant-

accused Suraj Pratap Mawai S/o Lokendra Singh, is hereby allowed and the applicant-accused is ordered to be released on bail upon furnishing a personal bond of ₹50,000/- with two sureties of like amount to the satisfaction of the Trial Court with the following conditions:-
