Order

1. The writ petition has been filed with the following prayers:-

“I. Issue an appropriate writ, order or direction, quashing and setting aside the impugned order dated 23.03.2026 (Annex-9) passed by the respondent no.3;

II. Issue an appropriate writ, order or direction, including a writ of mandamus, directing the respondents to consider the candidature of the petitioner for appointment to the post of Patwari-2025 and revive the appointment order of the petitioner;

III. Issue an appropriate writ, order or direction directing the respondents to grant appointment to the petitioner to the post of Patwari with all consequential benefits.

IV. Issue an appropriate writ, order or direction restraining the respondents from finalising the selection/appointment process for the post of Patwari insofar as it affects the petitioner, till a lawful consideration of the petitioner's candidature is undertaken.

V. Direct to Relax/Relax the condition of Education Qualification mentioned in the note no.1 of Condition no. 6 of the advertisement dated 20.2.2025 which states that "the person should have acquired the required education qualification prior to the date of examination" by considering the result of RSCIT of the petitioner for the post of Patwari;

VI. Any other order or direction which this Hon'ble Court deems just and proper in the facts and circumstances of the case may also be passed in favour of the Petitioner.”

Brief facts of the case, as stated in the writ petition, are that on 20.02.2025, respondent No. 4 issued Advertisement No. 02/2025 for recruitment to the post of Patwari, pursuant to which the petitioner applied by submitting online application form on 23.03.2025 under the category “Widow”, having already enrolled in the RS-CIT course on 19.03.2025 and duly disclosed the same in the application form; the petitioner was permitted to participate in the recruitment process, appeared in the written examination held on 17.08.2025, was declared successful on 03.12.2025, and upon document verification, was selected and allotted Salumbar district vide order dated 23.02.2026; however, during subsequent verification, it was noted that the petitioner had passed the RS-CIT examination on 09.09.2025, i.e., after the written examination, and on this basis, Respondent No. 2 vide communication dated 17.03.2026 declared the petitioner ineligible, pursuant to which Respondent No. 4 cancelled the petitioner’s appointment order on 23.03.2026, despite the petitioner having disclosed her qualification status and having been allowed to participate in the entire selection process without any prior objection.

Learned counsel for the petitioner submits that the respondents in the advertisement No. 02/2025 dated 20.02.2025 had laid a specific note under the eligibility and educational qualification column that even the candidates, who are appearing or would be appearing in the examination of the education qualification prescribed, would be eligible to participate in the said recruitment, however, they are required to obtain the qualification before the date of the written examination. He submits that the petitioner in the application form had mentioned the details in respect to the RS-CIT certificate that she is an appearing candidate and so much so that she has also mentioned the roll number that was assigned to her. He submits that there was no fault of the petitioner and the respondents, however, could have rejected the application of the petitioner at the inception when she was not having the requisite qualification. He submits that the petitioner was permitted to duly participate in written examination and the petitioner fared well in the examination and was issued an appointment order dated 23.02.2026 (Annex.6), however, at the time of document verification, the candidature of the petitioner has been rejected solely for the reason that the petitioner was not having the requisite qualification of RS-CIT on or before the date
