Candidates selected for government posts should be permitted to join service even if an investigation into their certificates is pending, provided the state retains the right to take action if the documents are later found to be forged.

Headnote:The petitioners sought a writ of mandamus directing the respondents to issue appointment and joining orders for the post of Junior Accountant under the outstanding sportsperson category pursuant to an advertisement dated 20.06.2023. Although posting orders were issued after document verification, the respondents refused to allow the petitioners to join due to a pending investigation by the Special Operations Group (SOG) regarding the authenticity of their sports certificates. The primary issue was whether the petitioners should be denied joining while an investigation into their certificates is ongoing. The court observed that in a similar controversy in "Arvind & Ors. v. State of Rajasthan & Ors.", a Co-ordinate Bench had directed the authorities to permit joining while granting liberty to the SOG to investigate and take action if certificates were found to be forged or fabricated. Consequently, the present writ petition is allowed.

Order

By way of filing the present writ petition, the petitioners have prayed for the following reliefs:

“It is, therefore, humbly and respectfully prayed that:-

A. By an appropriate writ order or direction, the present Writ Petition may kindly be allowed and the respondents may kindly be directed to issue appointment orders to the petitioners on the post of Junior Accountant under the outstanding sportsperson category in pursuance of the Advertisement dated 20.06.2023 (Annexure-01) issued by the Rajasthan Staff Selection Board, Jaipur.

B. By an appropriate writ order or direction, the respondents may kindly be directed to allow the petitioners to join their services on the post of Junior Accountant under the outstanding sportsperson category in pursuance of the Advertisement dated 20.06.2023 (Annexure-01) issued by the Rajasthan Staff Selection Board, Jaipur, with all consequential benefits.

C. By an appropriate writ order or direction, the respondents may kindly be directed to issue appointment orders to the petitioners on the post of Junior Accountant under the outstanding sportsperson category in parity with the candidates similarly situated to the petitioners.

D. By appropriate an writ order or direction, any order passed by the respondents denying appointment and joining to the petitioners on the post of Junior Accountant under the outstanding sportsperson category in pursuance of the Advertisement dated 20.06.2023 (Annexure-01) issued by the Rajasthan Staff Selection Board, Jaipur, may kindly be quashed and set-aside.

E. By an appropriate writ order or direction, any order rejecting the candidature of the petitioners for the purpose of appointment on the post of Junior Accountant under the outstanding sportsperson category in pursuance of the Advertisement dated 20.06.2023 (Annexure-01) issued by the Rajasthan Staff Selection Board, Jaipur, may kindly be quashed and set-aside.

F. By an appropriate writ order or direction, the respondents may kindly be restrained from rejecting the candidature of the petitioners for the purpose of appointment on the post of Junior Accountant under the outstanding sportsperson category in pursuance of the Advertisement dated 20.06.2023 (Annexure-01) issued by the Rajasthan Staff Selection Board, Jaipur.

G. By an appropriate writ order or direction, the respondents may kindly be restrained from giving appointments to other candidates in place petitioners on of of the the post Junior Accountant under the outstanding sportsperson category in pursuance of the Advertisement dated 20.06.2023 (Annexure-01) issued by the Rajasthan Staff Selection Board, Jaipur.

H. Alternatively, by an appropriate writ order or direction, the respondent authority may kindly be directed to complete the pending inquiry against the petitioners, if any, in a time bound manner and during the pendency of the aforesaid inquiry, the petitioners should not be denied appointment on the post of Junior Accountant in pursuance of the Advertisement dated 20.06.2023 (Annexure-01) issued by the Rajasthan Staff Selection Board, Jaipur, and furthermore, the respondent authority may kindly be directed to allow the petitioners to join their services on the post of Junior Accountant under the outstanding sportsperson category.

I. Any other appropriate writ order or direction which this Hon'ble Court may deem just and proper in the facts and circumstances of the case may kindly be passed in favour of the petitioner.

J. Writ petition filed by the petitioner may kindly be allowed with costs.”
