Interim bail may be extended on humanitarian grounds when a medical report verifies a critical health condition of a close family member and the petitioner is the sole available caregiver.

1. Instant application (IA No.01/2026) has been filed seeking to extend period of interim bail granted to the petitioner by this Court vide order dated 10.04.2026

Learned counsel for the petitioner submits that the petitioner was earlier granted interim bail for a period of 30 days on account of the serious heart ailment of his mother, who had been advised to undergo cardiac surgery. It is further submitted that, owing to certain medical complications, the proposed surgery could not be performed within the said period. It is further submitted that the petitioner's mother has been advised hospitalisation by treating doctor for blood transfusion. Learned counsel further submits that the petitioner is the only family member available to look after and attend his ailing mother. He therefore, prays that period of interim bail granted to petitioner may be extended for further 30 days.

3. Vide order dated 14.05.2026 passed by this Court, the learned Public Prosecutor was directed to procure the medical report of the petitioner’s mother. Today, the learned Public Prosecutor has produced the report dated 15.05.2026 sent by the SHO, Police Station Shribalaji, District Nagaur, which reflects that the patient is presently not fit for surgery and has been admitted to the Medical Department by the doctor concerned.

4. Learned Public Prosecutor has opposed the prayer for extension of temporary/interim bail, however, is not in a position to dispute the fact that the petitioner’s mother is required to undergo cardiac surgery.

After considering the overall facts and circumstances of the case and upon careful perusal of the material available on record, considering the fact that petitioner’s mother has to undergo cardiac surgery as well as the report dated 15.05.2026, this Court deems it appropriate to extend the interim bail/temporary bail of the petitioner for a further period of 30 days.

In this background and for humanitarian grounds and there being no legal impediment to extend the period of interim bail/temporary, the instant application is allowed and the period of interim bail already granted to the convict-petitioner Hanuman Ram Alias Hadman Ram S/o Shri Jalaram, by this Court, vide order dated 10.04.2026 is hereby extended for a further period of 30 days on the same conditions/directions and the bail and bonds furnished by him in terms of the order dated 10.04.2026.

7. Let this misc. application be again listed on 02.07.2026. Learned Public Prosecutor shall be required to submit the compliance report of the order whether petitioner has surrendered or not.
