1. The instant bail application has been filed by the applicant

under Section 483 BNSS (439 Cr.P.C). The applicant has been

arrested in connection with FIR No. 297/2025 registered at

Police Station Boranada, District Jodhpur for the offence(s)

under Sections 85, 80(2) and 316(2) of BNS.

2. Learned counsel for the accused-applicant submits that the

applicant has been falsely implicated in the present case. He

further submits that, after completion of investigation, the challan

was filed against the petitioner under Sections 85, 80(2), and 108

of the BNS. He further submits that the petitioner is the sole

accused in the matter and is the husband of the deceased. The

complainant is the father of the deceased, namely Shyam Singh,

at whose instance the FIR was lodged, and Rishi Kumar, brother of

the deceased, is also a witness in the case. In the FIR, allegations

of demand of dowry were levelled against the petitioner, and it

was alleged that, due to such demand, the deceased committed

suicide. Learned counsel has further drawn the attention of this

Court to the statements of the complainant-father and the brother

of the deceased, submitting that both of them do not support the

case of the prosecution. He submits that, in their examination-in-

chief, they did not allege any demand of dowry or harassment

against the petitioner. Further, during cross-examination, they

denied that the deceased was subjected to any kind of cruelty or

that there was any demand of dowry by the petitioner soon before

her death. The applicant has been in judicial custody since the

date of his arrest. The trial is likely to take considerable time to

conclude. Therefore, learned counsel prays that the applicant may

kindly be enlarged on bail.

3. Per contra, learned Public Prosecutor vehemently opposed

the bail application.

4. This Court has considered the arguments advanced by the

counsel for the parties and perused the documents on record. The

statements of father and brother of the deceased clearly denies

the fact that the deceased was subjected to any kind of cruelty or

any demand of dowry was made soon before her death by the

petitioner. Both the witnesses have clearly turned hostile. In view

of the statement so far as recorded, the involvement of the

petitioner becomes doubtful.

5. Hence, keeping in view of the fact that conclusion of the trial

of the case is likely to take time and the prosecution has not

shown any apprehension of the petitioner fleeing away from

justice, in case he is enlarged on bail; but, without expressing any

opinion on the merits of the case, I deem it just and proper to

grant bail to the petitioner under Section 483 of BNSS.

6. Accordingly, the bail application under Section 483 BNSS

(439 Cr.P.C.) is allowed and it is ordered that the accused-

applicant Sanjesh Kumar S/o Maharaj Singh arrested in

connection with aforesaid FIR shall be enlarged on bail provided

he furnishes a personal bond in the sum of Rs.50,000/- with two

sureties of Rs.25,000/- each to the satisfaction of the learned

lower court for his appearance before the court concerned on all

the dates of hearing as and when called upon to do so.
