1. The present bail application under Section 483 of BNSS is
filed by the applicant-accused Krishan Kumar Dangi Alias
Krish Alias Kareshwar S/o Bhagwan Lal, seeking bail in
respect of a criminal case registered as FIR No.221/2024
dated 06.07.2024 registered at P.S. Bilara District – Jodhpur
Rural, for the offence under Sections 8/21 of NDPS Act.
2. Learned counsel for the applicant submits that the applicant
has been falsely implicated in the matter and the
investigation against him is complete and he is no more
required in investigation. He further submits that there are
no chance of fleeing of applicant accused from the
jurisdiction of this Hon’ble Court. He also submits that the
applicant undertakes not to repeat offence and cooperate
with trial, which will take time.

3. Learned counsel for the petitioner has submitted that no
recovery has been effected from the petitioner. He further
submitted that the present petitioner is arrayed as an
accused only on basis of a confessional statement of Ramesh
Bishnoi. He also submitted that the statement of co-accused
is not admissible under the law against the petitioner. He
further submitted that the present petitioner is arrayed as an
accused only under Section 29 of the NDPS Act. He further
submitted that initially the investigation was kept pending
against the petitioner, but after arrest of the petitioner on
04.02.2026, a supplementary charge sheet has been filed.
4. Learned counsel has further submitted that accused Girdhar
Singh @ Girdhari @ Gidiya @ Gadariya also charged for
offence under Section 29 of the NDPS Act on basis of
statement of co-accused, was granted bail by a Co-ordinate
Bench of this Court on 15.01.2025. He further submitted
that no other criminal case whatsoever nature was
registered against the petitioner.
5. Learned Public Prosecutor has vehemently opposed the bail
application and submitted that the allegations are grave and
serious in nature. He has also filed a report received from
concerned Police Station.
6. Heard learned counsel for the petitioner-accused and learned
Public Prosecutor. Perused the material placed on record by
both the parties.
7. On 06.07.2024, SHO PS Bilara, District Jodhpur Rural has
received an information about suspect possessing
contraband article and accordingly he reached at designated

place wherein he detained Ramesh Bishnoi. After serving a
notice, he searched Ramesh Bishnoi and recovered MDMA in
two plastic pouches having weight of 92 gram and 76 gram
respectively. Thus, total 168 gram contraband was
recovered. During interrogation, Ramesh Bishnoi has named
the present petitioner for supplying of MDMA. FIR
No.221/2024 dated 06.07.2024 was registered at P.S. Bilara
District – Jodhpur Rural, for the offence under Sections 8/21
of NDPS Act. The investigation further revealed that MDMA
was supposed to be delivered to Girdhar Singh @ Girdhari @
Gidiya @ Gadariya. Initially, a charge sheet against Ramesh
Bishnoi and Girdhar Singh @ Girdhari @ Gidiya @ Gadariya
was drawn and kept pending against the present petitioner,
but after the arrest of the present petitioner, a
supplementary charge sheet is filed.
8. A Co-ordinate Bench of this Court has already granted bail to
Girdhar Singh @ Girdhari @ Gidiya @
