1. These bail applications under Section 483 of BNSS are filed

Kanwra Ram seeking bail in respect of a criminal case

registered as FIR No.185/28 of year 2026 dated 09.03.2026

registered at Forest Chayan, District-Jaisalmer, for the

offence under Sections 9 and 51 of the Wild Life Protection

Act, 1972.

2. Learned counsel for the applicants submits that the

applicants have been falsely implicated in the matter and the

investigation against them is complete and they are no more

required in investigation. They further submits that there are

no chance of fleeing of applicant accused from the

jurisdiction of this Hon’ble Court. The applicants do not have

any criminal antecedents. They also submits that the

applicants undertakes not to repeat offence and cooperate

with investigation/trial, which will take time.

3. Learned counsel for the petitioners submits that the offences

for which these petitioners were charged is triable by

Magistrate First Class. They further submitted that no

recovery from the exclusive possession of the petitioner has

been made by the Investigating Agency. They also submitted

that there is no direct evidence against any of the petitioner.

Further it has been argued that one criminal case registered

against the Muna Ram that under the Wild Life Protection Act

is pending. Two other criminal cases were registered against

Nara Ram and both related to IPC. Further one case is

registered against the Nara Ram.

4. Learned Public Prosecutor has vehemently opposed the bail

applications and submitted that the allegations are grave

and serious in nature.

5. Heard learned counsel for the parties and learned Public

Prosecutor. Perused the material placed on record by both

the parties.

6. On 09.03.2026 an information is received about haunting of

Chinkara near field firing range. The forest department has

initiated action and FIR No.185/28 dated 09.08.2026 was

registered. All three petitioners were arrested and Forest

Department has recovered several articles and knives from

these petitioners. Thereafter a complaint has already been

filed before concerned jurisdictional Court. These petitioners

are in custody since 10.04.2026 and the offence is triable by

Magistrate First Class but at the same time it is necessary to

protect wild life of the State as Chinkara is one of the

endangered species and is in process of extinction. Having

considered the material placed on record and also the nature

of crime the bail applications can be allowed but subject to

certain stringent conditions.
