HIGH COURT OF RAJASTHAN (JAIPUR BENCH)
Chandra Prakash Shrimali, J
Vijay Goyal – Appellant
Versus
Central Bureau Of Investigation – Respondent
S.B. Criminal Miscellaneous 2nd Bail Application No. 4430/2026

Advocates:
For the Appellants/Petitioners: P.C. Sharma
For the Respondents: Pradeep Kumar

Bail may be granted on humanitarian grounds, parity with co-accused, and delayed trial, especially when the accused is elderly and the sole caregiver for a terminally ill parent, provided there is no risk of fleeing and no recovery of alleged bribes.

Headnote:(A) Prevention of Corruption Act - Sections 7, 8, 9, 10 and 12 - Bail - Discretion of the Court - Consideration of the length of custody, age of the accused, humanitarian grounds, and parity with co-accused - Bail application granted where trial is likely to take significant time and there is a humanitarian need for the accused to care for an ailing parent. (Paras 7, 10)

Facts of the case:
The petitioner, Vijay Goyal, was accused of paying bribes totaling ₹50,000 to influence decisions in favor of Golden Care Colony and Modilabs Pvt Ltd. He has been in judicial custody since January 7, 2026. He is 70 years old and the sole caregiver for his 93-year-old father who is suffering from cancer. All other co-accused, including Suresh Singh, Sunita Meghwal, Manish Kumar Sharma, and Puran Lama, have already been granted bail by the trial court.

Findings of Court:
The court noted that despite the charges being filed on January 23, 2026, no charges have been framed, and the testimony of 28 witnesses is still pending, indicating that the trial will take considerable time. Furthermore, there was no recovery of bribes from the petitioner's possession. The court emphasized the petitioner's age and the critical health condition of his elderly father as significant factors for granting relief.

Issues: Whether the petitioner is entitled to bail based on the duration of custody, parity with co-accused, and humanitarian grounds regarding his aged and ailing father.

Ratio Decidendi: The court ruled that when the trial is delayed, no charges have been framed, co-accused have been released, and there are compelling humanitarian reasons—such as the advanced age of the accused and the need to care for a terminally ill parent—granting bail is appropriate to avoid violation of constitutional rights to liberty.

Result: Application allowed.
