By way of filing the present writ petition, the petitioner has

prayed for the following reliefs:

“It is, therefore, humbly and respectfully prayed that writ

petition of the petitioner may kindly be allowed and by an

appropriate writ, order or direction: -

(A) The respondents may kindly be directed to consider the

candidature of the petitioner under the category of Schedule

Cast, Outstanding Sportsperson Female.

(B) The respondents may kindly further be directed to include

the name of the petitioner in final merit List issued on

07.10.2023 (Annx.5) for all categories, while treating her

candidature under Outstanding Sportspersons category. If felt

necessary, this list may kindly be quashed and the respondents

may kindly be directed to prepare a fresh select list by including

persons like petitioner.

(C) That if petitioner is found otherwise eligible then she may be

given appointment on the post of Nursing Officer (N.T.S.P) in

pursuance of the Advertisement dated 05.05.2023 (Annex.1)

with all consequential benefits.

(D) That the petitioner may also kindly be granted relief in

consonance with the facts stated and the grounds taken in the

memo of writ petition.

(E) Writ petition filed by the petitioner may also kindly be

allowed with costs.”

2. Learned counsel for the parties at the outset, jointly

submitted that the controversy involved in the present writ

petition has already been set to rest by the co-ordinate Bench of

this Court at Jaipur in a batch of writ petitions led by S.B. CWP

No.234/2025 titled as ‘Sumitra Runia v. State of Rajasthan & Ors.’

decided on 15.12.2025.

The operative portion of the order dated 15.12.2025 passed

by the co-ordinate Bench of this Court at Jaipur in Sumitra

Rania’s (supra) is reproduced below for ready reference:

“...In view of the discussion made hereinabove, these writ

petitions are disposed of in the following manner:

(I) The respondents shall consider and examine the claim of the

petitioner(s) regarding their status as outstanding

sportspersons in accordance with the rules and policy of the

State, as interpreted by this Court in ratio as referred

hereinabove.

(II) The petitioner(s) shall be at liberty to submit a

representation within a period of four weeks to the respondents,

in addition to the claim already made by them, with all

supporting documents.

(III) The respondents shall examine the participation and

recognition, including affiliation, strictly in accordance with the

policy of the State. If the claim of the petitioner(s) is found to

be true and correct, the respondents shall consider the

candidature of the petitioner(s) under the outstanding

sportsperson category, strictly in accordance with the merits of

the recruitment process.

(IV) In case of any deviation or rejection of claim, a reasoned

and speaking order shall be passed by the concerned authority

and the same shall be communicated to the petitioner(s) by e-

mail or through speed post.

(V) The petitioner(s) shall be at liberty to re-approach this Court

by filing an appropriat
