1. Heard learned counsel for the parties.

2. The present habeas corpus petition has been filed by the

petitioner who claims himself to be the husband of the corpus ‘Ms.

A’ and she is stated to be in the illegal detention of the private

respondents.

3. In pursuance of the directions issued by this Court, ‘Ms. A’

was produced before us on 11.05.2026. We conferred with the

corpus and since the corpus was unable to decide judiciously and

we found that she is in some pressure, therefore, she was allowed

to stay for a night in Nari Niketan, Jodhpur.

4. Today, the corpus was again produced before us. We have

conferred with the corpus as well as the parents of the petitioner

and the corpus, who is present in the Court, and a detailed

interaction has been taken place between the two families. The

two families have resolved that the relationship of the petitioner

and corpus is acceptable provided a joint reception is held as per

the social customs.

5. The corpus has expressed the desire to either live with the

present petitioner or if the same is not acceptable to her parents,

then she would like to stay in the Nari Niketan, Jodhpur. In

whatever situation she has expressed the desire to go with the

present petitioner with whom she has solemnized marriage, we

feel that since the corpus is 21 years of age and is holding the

qualification of B.A., B.Ed., she understands her well-being quite

well. Since the corpus is a mature person and after a detailed

interaction with her, we feel that she has expressed desire to

cohabit with the present petitioner, therefore, we dispose of this

writ petition with the liberty to the corpus to live with the

petitioner and at a place of her own choice.

6. The investigating agency is, therefore, directed to see to it

that she reaches the place of her choice safely.

7. It is made clear that if both the families wish to hold any

reception, they will be free to do it in accordance with the social

customs.
