1. Instant writ petition is preferred by petitioner with following
prayer:
"I. This Hon'ble Court may kindly graciously please to accept the writ petition of the
petitioner.
II. By appropriate writ order or direction, Rs 21,48,010 has not been received for, may be
granted to the Petitioner;
III. By appropriate writ order or direction, the respondents may be directed retirement pension and other retirement benefits of the petitioner in compliance to order dated
01.05.2019 passed by this Hon'ble Court.

IV. By appropriate writ order or direction, the respondents may be directed to grant Assured Career Promotion (ACP) to the petitioner due on 25/01/1992 for 9 years, the benefit of which was given to the petitioner on 30.04.1997; the benefit of 18 years to be given to the petitioner on 30/07/1993 which was actually given to him on 06/09/2009; the benefit of 27 years to be given to the petitioner on 30/07/2002 which was never given to him as the petitioner superannuated
on 31/12/2010.
V. By appropriate writ order or direction the Petitioner may be given all the rightly accrued amount of Rs. 21,48,010/- as per order dated 01/05/2019 due and accrued benefits to the
Petitioner @12% p.a;
VI. By appropriate writ order or direction the respondent may be directed to send their employer's share to the PF department for
Petitioner's CPF;
VII. By appropriate writ order or direction, the Petitioner's fixation may be done from 20/06/1990 which was done from 30/04/1997 and arrears for 7 years may be given to the
Petitioner."
2. During course of argument, learned counsel for petitioner
submits that the issue relating to grant of assured career promotion (ACP) was deferred and not considered only because of pendency of certain charge-sheet but now vide order dated 10.05.2023 the respondents have informed that pending three charge-sheets have been settled and nothing is pending againsthim. He further submits that as per letter

dated 10.05.2023, the charge-sheets having no effect upon grant of the scale, so petitioner is entitled for consideration of grant of ACP after completion of 9 years, 18 years and 27
years from date of his appointment.
3. Learned counsel for respondents candidly admits that there
is no departmental proceedings pending against the petitioner, who has already been superannuated on 31.12.2010 and after disposal of all matters against the petitioner, the department will consider the pending issues
relating to grant of ACP in accordance with the rules.
4. Having considered the submissions of learned counsel for the
parties and on perusal of material placed of record, the writ petition is disposed of with direction to the respondents to examine and consider case of grant of ACP to the petitioner on completion of 9 years, 18 years and 27 years from date of his appointment, of course subject to provisions of rules. The respondents are directed to also issue fixation order as
per grant of ACP to the petitioner.
5. The entire examination is to be completed within a period of
60 days from date of receipt of copy of this order and the arrears are required to be paid in anoth
