HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR
Sameer Jain, J
ANIS S/O IQBAL – Appellant
Versus
THE STATE OF RAJASTHAN – Respondent
S.B. Criminal Miscellaneous 2nd Bail Application No. 4013/2026

Advocates:
For the Appellants/Petitioners: Tarun Jain
For the Respondents: Shree Ram Dhakar

Bail may be granted to youthful offenders in cybercrime cases after the charge-sheet is filed, provided stringent conditions regarding financial transactions, digital device usage, and electronic surveillance are imposed to prevent recidivism and ensure rehabilitation.

Headnote:The application was filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita for bail in connection with an FIR registered for offences under Sections 384, 419, 420 of the Indian Penal Code and Sections 66C, 66D of the Information Technology Act. The accused, a 23-year-old individual, had been in custody for a significant period and the charge-sheet had already been filed. The court found that the age of the applicant and the completion of the investigation were sufficient grounds to consider enlargement on bail. The primary issue was whether the accused-applicant should be granted bail despite the gravity of the cyber offences. The court reasoned that while the nature of the crime is serious, the applicant's youth and the fact that the charge-sheet is filed justify release, provided that stringent conditions are imposed to ensure electronic surveillance and prevent further digital crimes, referencing established directions for cyber-offence bail conditions. Accordingly, the bail application under Section 483 BNSS is allowed.
