Interim bail may be granted to an accused for attending a close family member's marriage upon verification of the event, without examining the merits of the case, subject to strict conditions and a fixed surrender date.

Order

1. Instant bail application is filed under Section 483 of BNSS for interim bail in a matter arising out of FIR No. 0257/2024 dated 02.03.2024 registered at Kanota, District Jaipur City (East) for offences under Sections 8/20 , 8/25 of NDPS Act.

2. This Court is only considering interim bail application of the petitioner accused on the ground of marriage of sister of petitioner accused.

Learned counsel for appellant submits that the marriage of sister of present appellant is scheduled on 14.05.2026 and it is a significant family event and his presence is essential to fulfill his familial obligations. He also submits that he will surrender before the authorities immediately after the marriage ceremony, ensuring that his temporary release does not disrupt the legal process. So, in light of exceptional circumstances and the importance of family ties he needs interim bail.

4. Aforesaid contentions were opposed by the learned Public Prosecutor. A verification report has been submitted by Public Prosecutor and he submits that as per verification by Police, the marriage of sister of petitioner-accused is scheduled on 14.05.2026.

5. Heard learned counsel for the petitioner and the learned Public Prosecutor and perused the material placed on record.

6. Having considered the fact that marriage of sister of present appellant is scheduled on 14.05.2026, it is appropriate to allow application for bail (interim) for a period of 4 days from 13.05.2026 to 16.05.2026.

At this stage, it is not possible to examine the facts as alleged against the petitioner; but taking into consideration the marriage of sister of the Petitioner, this Court is inclined to grant interim bail for period of four days (till 16.05.2026) so that the petitioner may participate in the marriage of his sister to be performed on 14.05.2026.

In view of the aforesaid, interim bail application is allowed and Petitioner Kishan Sansi S/o Shri Pappu Sansi is ordered to be released on interim bail for a period of four days from 13.05.2026 to 16.05.2026 on furnishing two sureties of ₹50,000/- each and a personal bond of ₹1,00,000/- to the satisfaction of the trial court with the following conditions:

(i) That after release on interim bail, the Petitioner shall after participation in the marriage of his sister, shall surrender before the prison authorities on or before 16.05.2026 latest by 5:00 p.m.

(ii) During this period of bail, the Petitioner shall not indulge in any criminal activity and shall not associate with any criminal elements.

(iii) The Petitioner shall not travel to any other place except Revenue district Jaipur.

9. Misc. Application stands disposed of.
