Directs the State and Union to implement stray dog removal, sterilization, and vaccination under the Animal Birth Control Rules, 2023, establish district Animal Welfare Boards, and create a mandatory registration system for potentially threatening pets to ensure public safety.

Issue notice to the respondents.

Mr. GS Gill, learned Additional Advocate General accepts notice on behalf of respondent Nos.3 & 4.

Learned AAG shall file a detailed report with respect to the action taken by local municipal authorities in terms of the directions issued by the Hon’ble Supreme Court regarding removal of stray dogs, providing adequate fencing gates in and around the places where there are educational institutions, hospitals, sports complexes, bus terminals, railway stations and also in smaller townships in and around Primary Health Centres (PHC). A separate wing be created for removing the stray dogs from and around public roads. The dogs so captured would have to be sterilized and vaccinated in accordance with Animal Birth Control Rules, 2023. Affidavit shall also contain steps taken for providing adequate Anti Rabies Vaccines in all Primary Health Centres (PHC), Community Health Centres (CHC), dispensaries and hospitals.

Issue notice to the Union of India and Animal Welfare Board of India, who would file an affidavit informing about the steps taken to establish the Animal Welfare Board at the district levels and ensuring Standard Operating Procedure to be provided for prevention of dog bites.

Instructions would have to be issued by the State Authorities as well as by the Union of India to the establishments governed under the Union of India at the State level and also the private institutions to take appropriate steps for removal of stray dogs in their respective institutional areas. For effective implementation of the directions issued by the Hon’ble Apex Court, steps for setting up an accountability procedure on the respective responsible officials shall also be undertaken. All steps should be demonstrably taken to prevent instances of dog bites, which may pose a threat to human life, especially to children and the elderly. The State Authorities as well as the State Legal Services Authority through DLSA, in coordination with Municipal Cooperation and Veterinary Department, shall take steps to educate, at the grass root level, the method and manner to tackle such situation and monitor and NGOs should also be encouraged for the said purpose.

In terms of the judgement passed by the Hon’ble Apex Court, we also direct the State Government to take steps for getting all the pets, who may threaten human life including dogs, to be duly registered and a time-frame may be laid down for the purpose with consequential penalties, which may be imposed in terms of fine, etc.

Compliance of the aforesaid orders and the directions issued by the Hon’ble Supreme Court shall be placed before this Court before the next date.
