The court observes that farmers are being forced to sell crops at lower prices, causing significant financial loss. The court frames the issue as one of grave public importance, noting that it is the duty of a welfare state to ensure farmers can sustain their livings. The court directs the impleadment of the Food Corporation of India (FCI), Krishi Vikas Sahakari Samiti, and Rajasthan State Co-operative Marketing Federation Ltd. (RAJFED) to ensure all responsible parties are before the court. The court ordered the issuance of notices to the newly impleaded parties and directed the State and Union authorities to file status reports and affidavits regarding MSP procurement steps.

Order

The issue raised in the present petition is of grave public importance and requires to be addressed too by the State Government, Union of India as well as by the Food Corporation of India (FCI).

The FCI is not a party to the present petition and we, therefore, direct the FCI to be implemented as a party.

Issue notice to Food Corporation of India.

Mr. Bharat Vyas, learned Additional Solicitor General is directed to take instructions in this regard.

So far as the State Authorities are concerned, we notice that Krishi Vikas Sahakari Samiti and Rajasthan State Co-operative Marketing Federation Ltd. (RAJFED) are also required to be implemented as parties.

Issue notice to Krishi Vikas Sahakari Samiti and Rajasthan State Co-operative Marketing Federation Ltd. (RAJFED).

Mr. G.S. Gill, learned Additional Advocate General shall take instructions in this regard from the concerned federation as well as society. They may also represent themselves through a separate counsel, if need so arises.

Learned counsel appearing for respondent No.5 shall file specific affidavit pointing out as to what steps are taken for purchase of crops being produced by the farmers at the Minimum Support Price (MSP) and whether there is any discretion available with the authorities not to purchase the crops, as pointed out by the petitioner-in-person like Makka, Bajra, Moong and Chana.

It is also pointed out that in spite of the crops being of the standards, the same are not being purchased or procured by the authorities. Resultantly, the farmers are being forced to sell their crops at much lower price causing loss to them.

Prima facie, submissions made at the Bar reflect the genuine grievance of the farmers. It is the duty of the welfare State to see that the farmers’ crops are sold in a manner that they are able to sustain their livings.

Mr. G.S. Gill, learned Additional Advocate General shall place before us the present status report as well as suggestions as to how the problems of the farmers can be meted out.

Mr. Bharat Vyas, learned Additional Solicitor General shall also submit the stand of the Union of India as well as of the FCI before the next date.

List on 30.07.2026.

It is made clear that no further time shall be granted as this petition is pending since long and if reply is not filed, the concerned officer-in-charge shall remain present before this Court on the next date.
