Order

18/09/2026 Heard learned counsel for the parties, and perused the material available on record.

The petitioners have preferred this bail application under Section 483 of BNSS wherein they have been arrested in connection with FIR No.10/07 of the year 2026, Police Station Regional Forest Ofice IV Bharewala, District Jaisalmer, for the offences punishable under Sections 9 and 51 of the Wildlife Protection Act, 1972.

Learned counsel for the petitioners submits that the offences alleged against the petitioners are triable by the Court of Magistrate and that the petitioners have been falsely implicated in the matter. He further submits that the petitioners have been in judicial custody since 07.08.2026 and that the trial is likely to take considerable time to conclude.

[2026:RJ-JD:45326] (2 of 2) [CRLMB-11446/2026]

Per contra, learned Public Prosecutor has vehemently opposed the bail applications.

This Court has considered the submissions advanced by learned counsel for the petitioners and finds that the offences alleged against the petitioners are triable by the Court of Magistrate. It is also noticed that the petitioners have been in judicial custody since 07.08.2026.

Hence, keeping in view the overall facts and circumstances of the case; conclusion of the trial of the case is likely to take time; the prosecution has not shown any apprehension of the petitioners fleeing away from justice, in case he is enlarged on bail; but, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the petitioners under Section

483 of BNSS.

Accordingly, this bail application filed under Section 483 of BNSS is allowed and it is directed that petitioners – Sadar Khan S/o Khamishe Khan and Shaitan Ram S/o Bhera Ram, shall be released on bail in connection with aforesaid FIR, if not wanted in any other case, provided they executes a personal bond in the sum of Rs.50,000/- with two sound and solvent sureties of Rs.25,000/- each to the satisfaction of learned trial court for their appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
