1. In spite of due service, no one has appeared for the respondents.

2. Considering the disputes having arisen between the parties and in view of Article 14 of the Agreement which mentions of the disputes being resolved through a sole arbitrator and due notice dated 12.05.2025 having been served on the respondents, the [2026:RJ-JD:43618] (2 of 2) [ARBAP-80/2025] application has been moved for seeking appointment of an arbitrator to resolve the disputes.

3. Article 14 of the Agreement reads as under:

"All matters, question, disputes, differences and/or claims arising out of and/or concerning and/or in connection and/or in consequences of breaches, termination or invalidity thereof or relating to this agreement whether or not obligations of the Lander, the Borrower, Guarantor(s) or any other person or entity under the Agreement subsisting at the time of such dispute and whether or not the Agreement has been terminated or purported to be terminated or completed, shall be settled by arbitration in accordance with the provisions of the Arbitration & Conciliation Act 1996 (as amended from time to time) and shall be referred to the Sole Arbitrator as nominated by the Lander, for arbitration. The award given by the Sole Arbitrator shall be final & binding on the Borrower and Guarantor(s). The venue of the arbitration shall be only at place mentioned in the schedule & Arbitration Proceedings shall be conducted in English Language."

4. This Court deems it appropriate to appoint Shri. Dalpat Singh Rajpurohit, (Retired District Judge) R/o H.N.46 Thar Meadows, opp. Veetrag City, Near Dali Bai Circle, Pal Jaisalmer Bypass, Jodhpur to act as the Sole Arbitrator to decide all issues without prejudice to the rights and contentions raised in the present application.

5. The arbitration fees shall be determined in accordance with the Fourth Schedule of the Act of 1996, as amended. The fee of the Arbitrator will be equally borne by both the parties. 6. The arbitration application is allowed accordingly.

7. Copy of this order be sent to the appointed Sole Arbitrator.
